We entered into a settlement agreement with the General Contractor. Part of the negotiation was an agreement to release the lien. The Levelset lien cancellation document is called "Satisfaction & Release of Lien". I am a little reluctant in sending this letter because of the verbiage "Satisfaction". Our debt is not satisfied and I would like to reserve the right to file lien at a latter date if the terms of the settlement agreement are not kept by the GC. Good evening! I am assisting a friend who owns a roofing company with a rather complicated situation and am hoping you can help assist me in moving forward in the right direction. Here is our situation.... Back in August of 2020 he accepted a roofing job where he had to completely tear off the whole roof and replace it along with other little side jobs he allowed the customer to add to the contract between the two of them that brought the total cost to $18,674.45. This amount does not include late fees, nor accumulated costs for the filing of a mechanics lien (which he was to late in filing so he paid the money, but per MN law, he did not meet the deadline in sending this to the homeowner). Filed a Bond Claim on a General Contractor for a public project. We supplied materials for an upgrade to a Waste Water Treatment Plant in Minnesota. The initial Bond Claim was filed on February 2021. The General Contractor made a payment and agreed to pay the balance. Therefore, we filed a Cancellation of Bond Claim. The Cancellation reserved the right to pursue collection of the remaining balance. The General Contractor still owes us money for the project and we need to file on their bond for the balance. I was hired by the homeowner to be the general contractor. I then was asked If work was available by an individual... so he worked under me for 2.5 weeks. Week 1 his hours worked and time on jobsite were very confusing....but managed to get through it . Week 2 the individual submitted 20 hours at end of the week. As the general contractor I disagreed with his hours cause I knew there wasnt 20hours of work for the week. So after going over hours with the worker we came up with 8 hours actually worked. Worker was told of tasks he was allowed to do. And at the end of the week worker said his tasks were all done. By the weekend when I went to check work completed I found the work was not completed. And other tasks that were not mentioned were completed... sorta worker applied shingles to an area with out proper code materials.now more materials will need to be bought, and time to tear off and proper materials layied down then time to re shingle.... a cost that was avoidable. Now worker wants his money and is threatening to put a lien on property....Read More

$40,000 dollar concrete job to include a egress window which is now installed and a 1,500 sf basement that I removed 2 layers of concrete and dug an additional 5" lower per customers likes. I require 1/2 of total job cost up front. He paid me only $8,000 up front and said he was going to pay the full $40,000 up front.. he paid me total of $10,000 then offered me $5,000 to pack up and walk away for no reason. No reason at all. I have more than $15,000 dollars into this job and only reason work could not continue in a timely manner is because the job was out of money. If the $20,000 or like he said he was going to do and pay total $40,000 up front the job would have been done. This total did not include the additional and labor intensive additional digging and cutting through 20" thick limestone for egress window. I'm literally out money from this job and lost 2 other projects for different customers totaling $62,000 just in loss of other jobs not including the losses on the project I speak of....Read More
