I am a homeowner. I hired a draftsperson to draw up my floor plans and elevations for a small addition on my home. I have an architectual degree. The draftsperson identified himself as an architectual designer/drafter. I signed a contract with him to do so. At our first in person meeting and his first visit to the site, the draftsperson showed up with 3 sets of floor plans and elevations that he alone had drawn up without meeting with me nor visiting the site nor using my drawings as requested. He demanded full payment before he would continue work on the project to integrate my floor plans, elevations and design ideas. He left the meeting in an angry state after I said he had not listened to me nor produced any work that I would find able to use. WIthin 20 minutes of leaving my home he sent a email, blaming me for everything, calling me names and threatening to sue me unless I paid him in full. I responded, with a request for mediation. He subsequently ignored my request and reportedly filed a lien and sent me a notarized copy of doing this. I want to fight this lien filing also believe his is misrepresenting his credientials and behaved in a scary and unprofessional manner. I am 67 years old and felt scared in response to his presence in my home. What do I do?...Read More

Work has been suspended on a private project in Mpls for a minimum of three months. We are a subcontractor. We have no contractual right to terminate in our subcontract for suspension. The Prime Contractor does have a right to terminate after 60 of suspension, but they are not going to exercise that right. Does that same right to terminate flow down to us even if the Prime doesn't exercise it? Also is there any statutory rights related to this scenario? Either for termination or cost of suspension. Contractor has made a complete mess of work performed. Windows were installed. Windows ordered were not received and company is only willing to reduce the final bill for window only. The crew left quite a mess of metal around the yard and driveway causing a tire to impacted and unrepairable. customer spent hours cleaning up the mess of metal, screws, nails, caulking wold like a reduction of 700 dollars total not just the difference in window price. Contract said after ten days of non payment they will file a lien on the house. $500 difference and a lien not great customer service. How long would this lien be in effect????...Read More

I am also a contractor, the contractor has not paid me, I do not have a written contract, however I have documentation that shows I was hired and agreed rates for the project, text messages and partial payment. I have received a partial payment from a property own. His son initially reached out to my company and set up the job. All documents required by MN were sent by the deadline(s). It was an emergency after a storm with an insurance payment. We were short payed by 30%. All attempts to settle were made prior to the mechanic's lien being filed. The customer still refuses to pay the balance owned. I would like to pursue this with a lien foreclosure. i did a construction project for a homeowner in Pipestone MN. this job was thru a referal from another of my customers. this job had a cost to the owner of approximately $14,000. They paid the first portion, but when the second portion and final payment were due she stopped payment on the check , then proceeded to drag me thru the courts and even had judge judy contact me. due to all of her antics the 120 day limit has long passed to file a mechanics lein on this womans property. the courts found in my favor with the case she tried to bring against me. I am still owed APPROX $8,000.00 On this project for labor and materials, and would like to tack on a 10% monthly fee for nonpayment and also the cost of going to court. for a total of about $20,000. what avenue can i take to get paid for my services from this woman.
