I was the roofing contractor for the person who bought this home, she found a leak and when I investigated the leak it was obviously repaired by someone with little to no knowledge of flat roofing. I recommended a restoration contractor, and I did a complete replacement of the flat roof part of the home. The contractor for so much damage an mold, he had to tear out all the drywall on both floors under that area. The new owner was so upset she never moved in and sold it. She is suing the owner and he is claiming he had no knowledge of this cover up. The original owner's attorney subpoenaed me and I gave a testimony, which then led her to request every email, every picture (over 500 at least we took), every document, the installation instructions,etc. They sent me a check for 35.00 with the subpoena for my time I believe. The deposition took 2.5 hours via zoom. This is 30-40 hours of work and I am not on trial. Do I have to do this? if so, Am I allowed to charge the industry rates for such a request? This roof is just under 500 sf. Contract amount was only $23,000 and I actually lost money on this because I felt so bad for the owner and aided in making sure they got good work from all trades. Hello. I recently got a call from the title company indicating that there's a lien to an LLC that own the property prior the LLC that I bought it from. I did my due diligence and bought the title insurance. However, the lien was done in 2020 but I purchase the home in December 2018. I do have a contract in place to sell the property, I will be able to keep moving forward and sell the property? Don't know what type of lien is as of now. Thanks, -RN...Read More

Our client has continually delayed our progress by lack of materials onsite, provided inadequate direction, which has led to issues onsite on multiple occasions. We've continued to demobilize and remobilize at no cost to our client, this has been due to the framing (not our scope) not being completed and lack of materials. I have a pay structure in all my contracts, it states that, Failure to comply with this payment structure is a contractual breach and will result in an immediate halt in work until payments are brought to date and another payment structure agreement is signed. The contractor I am working for has not paid for one of my invoices and i told him that work would proceed as so as I am paid up to date for work completed. He told me that the check is in the mail and he is terminating the contract. When he breached the contract doesnt that mean that he has no say at this point and should be handled in court. Also the other reason I wont move forward is because the house is rapped in plastic and there is water built up and there is no place for it to go and the whole house is going to mold if they move forward with drywall finishing. Also on top of that there is no insulation in the attic so all the tape on the ceiling is going to crack. How can he terminate contract after he breached it and job is not ready/ ...Read More

I'm a Electrical contractor , My customer is currently building his personal home ,Ive done business with him for many years . Great guy, unfortunately when he went on vacation last week he passed away. Sounds like there is no will or anyone to take care of these expenses . My guess is its going to probate. I completed the remodel to which the homeowner was completely satisfied and happy with. Paid me a d away I went. Shortly after a leak developed in the shower drain. The homeowner has argued and raised a huge fuss. Won't let me come fix the issue during normal work hours. Only gives me certain dates and times, usually after hours when he can supervise me for some reason. Won't let me just come over and fix it. Now is stating I'm not allowed to come over at all and probably expects me to pay for someone else to fix the leak. What should I do?...Read More

Levelset helped us file a lien on a residential customer who would not get back to us on minor job completion and collection. Once the lien was filed the live-in girlfriend called and said all we want is the switchplate covers installed and we'll pay. We did that and said give me our 16k balance and I will process the release of lien. I told them that's the process - not hand you a release of lien and then you hand me the check. They have gone dark again... What are my next moves - just wait out the next 8 months and then forclose - then he writes a check to save his 1.2 Million dollar house?...Read More
