I have a contractor renovating a building for me. It is a Cabin in the Upper Peninsula of Michigan. I made an over-payment of $6000 over six months ago. I caught the over-payment when I reviewed the contracts and estimates of material and labor. I also determined that there are two contracts for the same work except there was a revision that I requested. The revision was written in a different format. After reviewing those I adjusted the over-payment to $15500. I informed the contractor of the over-payments but he does refuses to consider refunding the money to me. How should I proceed? Should I simply consult a lawyer?
MichiganI am a sub contractor and have been completed with my part of the project since October 2021. My retention is still being held back because another sub contractor needs to finish some of their work. Do I have any lein rights to get them to pay me faster? It's a project at University of Michigan, Ann Arbor.
MichiganI'm a commercial painting sub contractor working at a U of M building in Michigan. I'm completely done with the project since December 31, 2021 and have been paid for all except our 10% retention. The General Contractor is saying that the owner will not pay out retention until two change orders are dealt with for another sub contractor (not us). This project started back in early 2021 and I don't see that the Office Manager at that time sent a Notice of Furnishings. Do we have any lein rights to collect our balance?
MichiganI just began my Levelset subscription today. I have a project that started in March worth $125,000. First ship date was March 14. I am past the 20 days after I first shipped. If I send a preliminary notice now, would it go back 20 days from today? So I would be covered for the work I've done since April 6 or so (give or take a few days)? The balance outstanding on this project is $80,400, so I have lots more work coming. I think I should send this notice now to be covered for whatever I can. Do you agree?

MichiganWe are a sub-contractor in New Jersey who provided labor to a job i Michigan. The last day of work and the invoice date were 11/24/2021. The General Contractor has refused to pay. We did not send a notice of furnishing to the General Contractor. (did not know the procedure). Can a lien still be filed?
MichiganI filed a lien against owner of job that we worked on. Come to find out the contractor we worked for also filed a lien against the owner and since we didn't as a sub go in on the lien we are now part of the lawsuit against the owner of the job. I filed the lien before the contractor did. I received a letter saying they would like alls subs to go in on the lawsuit. I had already filed a lien and didnt think it was necessary to go in with them. I didnt realize now we are part of the lawsuit. I dont understand how they can make us part of the lawsuit.

MichiganIm a contractor and my last date of work was late January. Sadly, my collection efforts have failed. I want to lien the residential property but I noticed that the home sold to new owners a month after I finished work. Can I lien the home even though there is a new owner?

MichiganHi there! If a sub forgot to sign a waiver during the course of construction (partial unconditional) will a full unconditional waiver cover the missed amount? As long as that payment is included in the total amount on the final? Example:
Missed June $100
Final Unconditional issued in July (including the missed $100 in June) for every dollar thesub was paid.
MichiganI have an unpaid invoice that was due in November of last year. I got the run around from the general contractor, and the accounts payable for awhile and gave them time not realizing how liens work.
Is there anything I can do from a legal standpoint this far out?
MichiganA company filed an invalid lien on a botched granite counter job after I called them to get the issue resolved and then ignoring my calls for months. They did not correct the major mistakes made on the job and filed after the 90 day period after installation. I need to get the lien removed as the property was sold before they placed the lien. I don't want to hire an attorney as it would cost more than what they say I owe. My invoice states I owe $500 but they are claiming $1600. I have proof that it the filing was after 90 days, there was no contract with statutory language. Just want to file with the court to prove my case and have the lien removed on a house I already sold. Please help.
