I am in the process of trying to sell my home. My realtor gave me the name of a friend of his that has done work for him in the past and stated he was a contractor. I have never hired anyone before to do work like this so I took the word of my realtor that this guy did good work. ( the realtor also sold me this home in 2015). The estimate was written on a note pad and neither of us signed it. He had me put the cashiers check in his name and not a business name. I guess I should have questioned that. He kept saying it was gonna be done by a certain time, but wan't getting it done.He never repaired any nail holes in walls before painting them. He put up some drywall where a furnace was removed and didn't let he mud dry before he painted it. Parts of the wall are darker shade of paint then others. The new countertop has a screw head pushing through. The counters were pushed up against the stove, but he moved one counter to match up with the top cupboard but never moved the counter on the other side of the stove so there is a big gap between the stove and one counter. With the two rooms that were painted poorly, he said he would deduct $500-600 of the remaining balance and we would have to redo the rooms ourselves. I told him that the reason that I hired someone in the first place was that we didn't have the time or help to be able to get it done in a reasonable time and the realtor and I wanted to have it done by Aug 5th,2022. I then suggested that he repaint the rooms and he furnish the paint ( I furnished the paint the first time) and also to knock off some money since now, it will take an EXTRA 5 days before he can get to it, which was already pas the original date he stated that he would get it done which was July 29th. Hi, I wrote my student loan holder “Nelnet” a letter specifying the settlement check amount as payment in full for the entire amount owed on my student loan. I also wrote paid in full on the check that that was enclosed with the letter. Nelnet cashed the check, but left a balance owed. My letter clearly stated my intention to settle my debt owed with the amount written on the check as payment in full. What course of action should I take next considering Nelnet received the paid in full settlement letter and cashed the paid in full check? Thank you. ...Read More

In May of 2020, after many delays and issues, a well respected, established and reputable contractor was hired to do extensive repairs to our home after a severe hail storm when they simply walked off the job in September of 2021. The job was 99% finished and there was still a balance due of many thousand dollars. We have not heard from the company since! Did the company just write it off? Im a general contractor and I had filed a lien for $20K in Nov of 2021. Since the filing of the lien, the customer made a partial payment of $4K, making the total amount owed $16K. Customer has hired an attorney who has threatened to sue me because my lien amount is incorrect and saying that I cannot enforce the original lien. My question is, can I amend the lien in MI after the 90 day lien period has passed but within the 1 year enforcement period? I paid an unlicensed contractor under the false pretense that they were licensed. This fraudulent contractor hired (subcontracted on his own authority) his friend to do the electrical work. The electrician is a licensed electrical apprentice, can this electrician file a lien against my property if he lies and says his friend didn't pay him? I did pay the contractor in excess of the work that he performed and am now in the process of trying to pursue civil litigation and criminal charges in order to get a reimbursement for some of the job. I had a general contractor come to my home to give me an estimate on three bathrooms remodels. . He started the job with a 50% deposit. The first two bathrooms that we’re done we’re done poorly and took triple time he quoted me for. After three months of trying to accommodate his needs I had to terminate him. I'm a homeowner that had a house fire. Builder hired drywaller and paid him half to begin work. Drywaller was detained by ICE and never finished, but placed a lien on my home. Same drywaller never paid for supplies and we were both sued by the drywall supplier. I paid and was released from the debt, he did not and was garnished. I'm a subcontractor who was working on a commercial development that had a stop-work order that went into effect before I was actually on the property. I completed design work, some labor (in warehouse), and ordered parts for the job (sprinkler heads that were in a shortage at the time and were ordered in bulk to avoid possible future work delays). These materials were not ever delivered to the job site, but are currently in my warehouse. I have a couple of questions about my lien rights: 1) What should I use as first furnishing date? I have a contract date of 2/10/22, a materials delivery (to me) of 3/23/22, and no date for me or materials being on the site, although I suppose it might be 5/6/22 (listing the job as started and ended on the same day)? 2) I may be able to get the cost of the materials (minus shipping and restocking) back from my supplier. If so, how does this affect a lien? Can I lien for the full amount and then amend the lien if I recoup some costs? 3) If I delay my lien while resolving these questions (I have three months left to file), will it put me later in the line to get paid? I've heard that order of filing impacts order of pay in bankruptcies and want to know if it applies to other situations as well.
