We are homeowners who hired a company to frame a 3rd floor to a dry-box. The framing team made many mistakes in the framing that are not structurally sound to say nothing of the fact that designs were not built to plan and the company has failed to deliver a dry box for an unreasonable amount of time (over 3 weeks of leaking onto second floor) They are now demanding payment even though the work isn't finished and are threatening to put a lien on the house. I'm a general contractor. We completed construction on 10/6/2021. The customer complained about issues and held payment until resolved. We have documented all resolutions and customer has still yet to pay the amount owed as of 3/21/2022. We are now wanting to file a lien for the remaining balance. We may have missed some of the deadlines because we were working on resolutions in good faith that the customer would pay us once resolved, but we would like to take measures to try and get paid and formally get the process of a lien going. are we out of luck or should we attempt to file? At the very least, we'd like the homeowner to see that we are serious by receiving the notices that we've filed because perhaps that will initiate a payment from them. ...Read More

I am a supplier of lighting fixtures to a job site in MA. At the end of Dec 2021 they wanted to Prepay us $300,000.00. Which we received from our GC. They are now asking us to sign an Unconditional Waiver for the Partial payment. On the Waiver is a balance still owed to us on the project of $ 60,000.00 approx - however subject to change based on the project going forward for actual changes on the job and price increase. We have tried twice sending these documents to them but both times via USPS and Fed Ex it says unable to deliver sending back to shipper.
