I had a client that did not finish paying me after completing a job, and I placed a mechanical lien through Levelset which it has been about 3 month by now since the lien was placed. The property owner have not reached out to me, what would happen next, can you plase advise? I thought this was going to help me to get paid but that did not happen. Hello, I am a home owner who recently had home improvements completed in Maryland. We paid the GC in full and were happy with the results. We were then surprised to receive a notice of intent to file a lien from one of the subcontractors. I spoke with the GC and he and the sub are currently having a payment dispute concerning our project. It appears the sub walked off the completion and indeed we noticed a different sub finishing things up. Frankly, I don't want to be invovled in their dispute but have now come to realize that Maryland homeowners may be required to pay for their home improvements twice if a sub files a lien. The home improvement project is less than 15% of our home value and will not add 15% to the value of our home. Does this make any lien invalid? What are other measures can we take to protect ourselves? We have a future, larger, project in preliminary stages (with a different contractor) that will be 15% of the home value. I intend to ask for a Preliminary Notice and Waiver of Lien to be added to the contract. Is this all I need to avoid a similar issue? Thank you, Vicky in MD...Read More

I am a Remodeling licensed contractor in Maryland. My company has been performing work at a clients home. Are agreement from the start was a day rate for 2 men $1600.00and I supply all materials needed with a 10-15 % markup. Once each phase was finished, a invoice was emailed with time and material breakdown. Customer then paid in full. This has been the on going practice for the past 6-7 months. Customer wanted to get custom cabinets made for there laundry room. Cabinets were picked out and priced. Customer agreed on price and signed the order form. Customer gave and authorized me to use there credit card to make approximately$ 27000.00 deposit on a $35711.72 order. Now with cabinets already made but not ship he want to cancel and receive full credit. Also included in cabinet purchase agreement was approximately 3 days of install work....Read More

Hi I'm a self employed handyman/carpenter who lives in PA and did said work in MD. I built a large horse farm fence for an older lady whos a racehorse breeder. She signed the contract for the work which stated the est project completion time would be 3-4weeks. During this project she asked me to stop fence work and build a shed, which I did. She asked me to stop and rehab a barn which I did. She then says initial fence job is taking too long and asked if someone else can finish the rest, to which I agreed. 4 Days later she text me back and asked if I could come finish fence because the other "contractor" only knew how to do a small part and wasn't experienced enough. I came back to finish fence and completed it.. Fence looks great and she is happy with the fence, shed etc... On my last work day there she says to me that the fence took long causing her to board horses longer than expected and she says she will only give me 8k instead of 13k because of this. She never had a deadline on our contract. It only said estimated time 3-4 weeks for fence job. If I subtract the time that she took me away to do other projects etc.. then the fence took 5 weeks. She agreed to barn contract through text msg but we only have a verbal agreement for shed, but I have witnesses and pictures of me and crew building it etc.. We talked a few days after fence was done and she doesn't want to budge and she says I guess you'll have to take me to court, but its expensive. I am being retaliated against by a group of nefarious individuals who place 'unwitting small business owners in a spider's web of unfairly weighted contracts with language intended to tie the hands and feet of unsuspecting businesses if they speak up and speak out when they realize these people are shady, greedy and working a criminal enterprise. Their sole purpose is to fraud the government and they even take the small businesses revenue which is outside of the rules for work percentages between them. I believe that they have done this before, and perhaps the others went along because they don't say much about what they are doing however, if someone like myself speaks up and questions them, they tighten the noose and become vicious in the manner in which they work to retaliate and destroy your small business. At the very least, would you please take a conference call with me and hear my story? I have plenty of emails that will prove my claims because they were written at the time these issues were being raised and argued between myself and the parties in question. I did not agree to fraud the government. Nor did I agree to allow these peoples to enrich themselves using my company. This group consists of a Contracting Officer, a SDVOSB, a Construction Manager, A Bonding Agent, A 3rd Party Escrow Agent (who recently packed up and moved to Florida October 2021), supposedly US Fire & Casualty and Crum & Forster (one of its reps asked me to provide my User ID and Password to a Subcontractor to have access to my WAWF account, which I found disturbing) since I learned we're not supposed to share this information. I'm a GC. 99% of the job is complete, and there is a punch list we were planning on completing. The customer ran out of money, and is trying to delay by adding on or exaggerating work to fully complete. I have reduced my invoice to account for the incomplete work, and want to get paid for work already completed. I have sent a new invoice reflecting the work completed, but continue to get push-back from customer. We agreed to have an independent inspector evaluate the work, and provide a list of items to be completed. The independent contractor's list is consistent with my list of work items. Can I file a lien, as this is now 5 months later and I want to get it done before the 180 day deadline in MD....Read More
