What do I do if a contractor does not show up to sign a lien waiver and recieve his check. I arranged a meeting at a local bank for notarization of lien waiver and exchange of final check. I sold property in Rockland Maine recently, and it had to have a new sewer drain field installed for a cost of $20,000. It is on my deed that the next door neighbor is responsible for 50% of the cost for their connection to my system.. The county want issue them a permit to build their own. New home build in Maine. Financed through a construction loan. Home is almost finished and I just got a final invoice and it is significantly more than the original estimate (which is how much my loan is for). We have made some changes along the way but never signed any change orders. The contractor gave me verbal prices for some of the changes and others I have the prices in text or email. The final invoice shows these as much more than what he told me they were going to be. I had money set aside to pay him for the overages based on what he told me they were going to cost. But now there is a difference of about $50,000 and I don't have that money laying around. Basically I budgeted for the changes I made throughout the build based on the prices he gave me. If I knew everything I chose to add to was going to be double what he told me it would be I wouldn't have added anything. What are my options? ...Read More

I have a cottage on a lake in Maine. Permanent home in Connecticut. In 2007 a contractor did work on the cottage. I paid him about $30,000.00. We parted because I was not happy with his work. i had paid all amounts due at that time. He later billed me for $9,000.00 saying he had removed the discount he had figured in the project. I thought he was crazy. I didn't pay this additional amount. Never heard from him again. Now I want to transfer the cottage to my daughter. There is a lien on the property from this contractor. Does this lien stay on the property forever? Can I get this lien remover because of the age of it ? Do I need to try to find this contractor from 2007 and have him remove the lien? ...Read More

We are a vendor/supplier and are presented with lien waivers very often. Occasionally we are presented with a blank waiver, asking us to complete the dollar amounts, dates etc. then confirm and notarize. As the notary, I refuse to sign if the customer has not completed the amounts/dates/invoice numbers they are requesting the waiver for. I feel we as the vendor are not responsible for completing the information on the waiver, only confirming and agreeing it is correct. Am I correct in this?...Read More

I will be using Levelset for the mechanics lien service. The customer has 2 properties, one #448 the other #500 on the same street. I purchased 3 items adding for the amount of $250 in her residence, #448. The contract work was on #500. That amount was verbally excluded on the first payment, $3750.00 minus the $250 = $3500. The items are in still in her residence. Plus I also did spend at least 2 hours, or more retrieving necessary items to be used to complete the contract on #500. Can I also put a lien on her residence #448 as well as the contracted # 500. In addition she told me in regards to signing the contract that I could buy a week in Saint Martins for $2000 which further enticed me to pick up the contract. For any and all the above reasons can I attach her residence in my mechanics lean since it did involve my contract and I did some work over there which I would have billed for.
