We are a GC, we were getting paid by the Owner from a check issued to the Owner by the bank. I was told by the bank the Owner was issued our final payment but the Owner decided to keep the money. We have filed a lien but, we are not interested in waiting years to get paid. How do we file a force foreclosure lawsuit?? We were toll by LevelSet, this is our last option. I work for a restoration company that assisted around New Orleans after Hurricane Ida. We completed mitigation services in December 2021 for a customer in Houma. Their insurance company went solvent, and the new adjuster finally released payment this month. Now, the customer has been ignoring us and we are left holding the bag. We had major damage from Ida….we hired carpenters, signed papers(they never showed us the whole contract) they gutted my house partially and then stopped. After 6 months of waiting for them to proceed and they didn’t….we told them we wanted to cancel the contract and now they are telling us we are going to have to pay the whole contract sum!! We are being asking to sign a Forbearance Agreement. By signing this agreement, we are stating we agree to the terms of the company to pay off it’s balance in 2022 in set amounts. The work we performed were on offshore decks and platforms and a traditional lien is a route we are unable to take. Hi, I am a home owner who hired a licensed plumber to tunnel under my home. I paid $6000 deposit prior to commencement of work, to cover the initial digging. Total job cost would be about $16,000. No Notice of Lien Rights document was provided to me. He started work Sept 23, 2019. After 2 weeks he had tunneled the main line. We ran into additional problems with other lines, so I had to file for additional insurance. Work was suspended. Insurance was dragging, then required an independent plumber to quote it. Our plumber got frustrated and on Dec. 2, via text messages, said he quit the job and to let the other plumber handle it; then proceeded to demand additional $3000 to stay on the job. I ignored his request. I considered him off the job at that point, although he frequently checked back in to see if insurance covered the additional work, to which I replied insurance was pending. In early Feb 2020 insurance gave me the number it would cover for the additional work. Out of courtesy I contacted this initial plumber, shared the 3rd party plumber's quote which was much lower than his, and asked for his updated quote if we wanted another stab at finishing the job. He did not provide in the time I requested, so I officially "fired" him in writing. Today he responded that he would now issue an invoice for supplemental "hard digging" fee and for the cost of his insurance for 5 months (Sept 23 - Feb 17), neither of which were line items on his quote/contract. If we didn't pay it, he would file lien. Regardless of his abandoning the job over 2 months ago, and regardless of his alleged bases for potentially filing a lien, can he even file a valid lien if he never gave us a Notice of Lien Rights prior to starting the job (or anytime thereafter)? If he can, does either the abandonment issue or the lien content invalidate his lien? Thanks! And please tell Scott that Hobbs says hello, and congrats on his business successes. We had a fiberglass pool installed in 2019. Since then , we have had multiple problems of leaking water, cracks and bubbles. Our contractor tried to repair (very pieces together)but the pool is worse off now with shoddy paint job, fiberglass is cracking again, uneven fiberglass, and the pool is unlevel and still leaking. Contractor has said multiple times and dates he will come to look at it but never shows up. Is this something we need a lawyer for? ...Read More
