I'm a subcontractor and did not send notice to owner of obligations but as a subcontractor in LA I don't believe I'm required to send such. The last work on the job to complete was 6/27/22, don't I get 6 months to file the lien or send notice to file?
LouisianaI am looking to start a Residential Contracting business in Louisiana. In the application to the state I see the Financial Statement Affidavit requirement. What I am unclear about is how to get this done since this is a new company. Can you inform me of how to satisfy this need for the application?

LouisianaIf an LLC owns the construction license of a contracting company, should the members of that LLC be listed on the license as well? In other words, do they each need to be licensed to bid, perform on projects? To complicate the situation, what if the primary owner of the contracting company is the LLC whose licenses are listed, but not his co-owner who performs the majority of the work.
LouisianaI did a job for a couple trying to open a restaurant. After finishing the job he paid me the remainder of what was owed in a check so I deposited into my account and then he canceled the check. He is now refusing to pay me the $2500.00 he owes me. How do I put a lean on the business and sue for whats mine?
LouisianaI’m a GC and was emailed a termination of contract notice. I filed a rush delivery to time stamp the claim against a homeowner. I received an email today dated past the 60 day window on my Statement of Claim form. I want to make sure my claim is protected and filed in good standing with the clerk of court office and no issues are to arise given the sensitivity of the deadline to file.
LouisianaGC hired SC to do work on 3 different jobs we had with same company at different sites. GC and SC had never had any written contract on verbal agreements to do work for 3 job. Job was accepted by SC $ amount x total sqft Sheetrock that was delivered to job-sites. SC all the working to to to final painting. Everything went great to the the last two bills were presented to use for payment. Everything State on invoice was wrong and we tried serval time to ask why or how she got that amount and refused to explain . I accounting work with GC. GC came to me and said SC says we owe this go back see what’s been billed and see what’s be paid and let me know .. I found out the last invoices were at a rate 3 times the amount of the invoice that were paid total already over $200 thousand . I found that the last two invoices were for patchwork on the job we have 34 homes that been gutted and paid for it look like they tried to make look other job that had been paid for 100 thousand again. They filed lein affivait and claim of privilege (lein) is says on sept 8. It has help GC final payment also SC attorney had no idea what was going on we tried to settle with him and he understand why she wouldn’t and she has present another two and the attorney has asked to setup appointment to discuss with him? Why would attorney was to know all we have saying we don’t owe it?
LouisianaMy roof contractor is demanding payment in full (partial payment was paid previously). He recently submitted supplements and my homeowner's insurance has not released all of the funds for the supplements or the depreciation for the roof claim. He came to my door demanding payment of a different amount than he had on a previous invoice he gave me that was from January. The amount he showed me was written in pencil. I told him that the insurance has not paid me in full and the supplements were in the pipeline to be paid but I don't have the money or a revised estimate from my insurance yet, so I will pay him for the work completed at the amount the insurance approved once they send that to me. He waved an estimate from my insurance in front of me with different amounts than the versions I have in my portal and said he can see that I am supposed to get X amount from my insurance for my entire claim so just pay him. This estimate appeared to have my entire claim information on it (for other areas of my home that he is not a contractor on) and he would not let me look at, hold or photocopy the document. Then he tried to say that I should get 20K in depreciation for my entire claim so I should just pay him now. I do not have in writing what the insurance has approved for the supplements, but from a rep I spoke to last week, he submitted supplements for work that he did not do (to include installing drip edge (he did not remove or reinstall any drip edge on my home), starter shingles installed (he used upside down regular shingles that did not match my roof and were obviously from another job) and those items are required per manufacturers guidelines and drip edge is required per buidling code. I texted him to say to send the invoice and we will compare to insurance and pay for what was completed and at the rate the insurance approved. He then said that he will have his attorney file in court for nonpayment and per his contract, I will owe attorneys fees for nonpayment claims. What recourse do I have? isn't he in breach of contract, guilty of fraud (for billing insurance/me for work he did not complete), or anything that allows us to not pay for attorney's fees? I am happy to pay for work completed, but my insurance hasn't paid me yet. I feel he is pressuring me with fraudulent documents and that should matter if it goes to court.
LouisianaI completed work including labor and materials on a commercial building in tangipahoa parish over 46 days ago. Customer will not pay even after multiple invoices sent, notice of intent to lien, phone calls, text messages and emails.

LouisianaWe used a third-party service (not Levelset) to file a notice for us on a public university project in Louisiana. The third-party uses an inhouse machine that post marks the notices as they are printed. For this project, the third-party printed & postmarked the notice several days before our notice deadline, but the envelope was not accepted at the post office until several days after our deadline. The third-party has stated the date accepted at the post office does not make a difference, and that the third-party has no control over when the envelope is accepted at post office. This seems doubtful, though, as any party could post mark a letter on a specific date and then walk it in to the post office days later. At what point does Louisiana consider an envelope to have been mailed?
