Hi, my then business partner used my business LLC credit card to purchase materials and labor to fund one of his housing projects in Missouri. He took my credit card statements to obtain draws from an Illinois bank that was funding the project. However, one month he kept $40k+ of the draw for himself, instead of sending it to me to pay off the credit card. Now he says he can't pay off the balance of $49k+ on my card. Obviously, the credit card company is going to sue me even though I never used the card myself. Is there anyway I can put a lien on the properties?...Read More
I'm a general contractor who provides tree services to my customers. I was contracted by the occupant/owner (at least he said he owned the property and residence) of a residence located in St. Louis county, MO. After completing 90% of the job the occupant/owner sent a text message telling me not to come back and that he had moved the Bobcat I had rented to complete his job from his backyard out into the street in front of his residence and that I had better hurry if I wanted to retrieve said property. He also kept my climbing rope and carabineer as I had left them on the base of the tree I was planning on dropping that day (the day he sent the text telling me not to come back). He knew going into the job that it was a $3,500 contract of which he paid $200 cash on day 2 of the job. The day he said not to return would have been day 4 (and the final day) of the job. He will not acknowledge any invoices and ignores all attempts to call/speak with him. Since he refuses to communicate I began the process of putting a lien on his property during which I discovered he is not the owner of the property, his sister is. I am unsure how this effects my right to file a lien. So, can I put a lien on the property despite the fact that my contract was with the occupant, not the owner? And if I can, what do I need to do and how do I do it? If I can't put a lien on the property since the contract was made with the occupant not the owner what recourse do I have? Is there anything I can do to try to get him to honor our contract and pay his bill? ...Read More
What can a homeowner do when a contractor (roofer) does shoddy, incomplete work on contracted roof system and Fascia.
50% paid, remainder still due upon completion of work. Work commenced 126.96.36.199. Ongoing and incomplete.
Roofers were supposed to replace bad, rotten decking. 92 year old plank decking, 60% bad, rotten decking. <1% replaced. Planks bowing, cracked w/ >1 1/2 " spaces, some planks half gone and blown out from "shiners" / bad nailing. Many nails hanging in space, through asphalt shingles only, not secured to decking. My attic filled with an unreasonable amount of debris. Construction owner said if he had done the job he would have replaced some other planks...
Asphalt shingles are bowed and warped. Confirmed by field rep on 10.31.22 when he came to respond to my leaking roof. Bowing and warping has gotten worse, (more shingles) since that date.
Roof was leaking in one place after roof system installed on 10.31.22.
Roof is now leaking from a second area since 12.14.22. Contractor came out on 12.17.22, could not fix the leak, has been putting me off since.
Per the contract Ridge ventilation was to be installed, instead they just replaced two turbines.
The specified underlayment brand on contract was substituted with two other brands. Underlayment was not properly installed; does not cover entire decking. Drip edge installed behind gutters: water now dripping down Fascia.
Could not open my garage door for one month because they blocked it with miss-measured rake Fascia, still they wrapped this with aluminum.
As of 1 20. 2023 I can only open my garage door partially.
Fascia was supposed to be cut back to remove 2'' rot from eave(s) ends, then aluminum wrapped. Roofers cut back to soffits 20", rendering my gutter system useless at that juncture and destroying the aesthetic of my 92 year old Craftsman home.
Fascia work egregious; exposed wood, not measured, cut and bent or installed properly. They have come out twice to fix this. The owner admitted their first guy had little experience, the second person could not do it either. The second person told me quote: "it was not his problem, he has other problems" The owner confessed that they don't really do fascia work... ?
All Fascia work remains incomplete and shoddy.
This is a partial list only of the shoddy, defective and incomplete work as of 1.20.2023
Damage to my property: This includes House, Front Portico, Attached Back Porch and Garage.
Leaking roof 10.31.22 - current
Water damage and mold in Attic as a result of Leak#1 and now leak# 2
Pounds of debris and plank decking on my attic floor. (this is a usable attic, not storage only)
Damage to garage Gutters from improper removal, now unusable, must be replaced.
Trusses on garage blown out from "miss nailing", particularly on their protruding, exposed ends.
Damage to the cement board siding on back porch(12 sections damaged: cracked and fallen out)
Damage to my wood deck, that was not protected properly as advised by Co.
Damage to existing Fascia/Eaves
PLEASE, what are my options?
I am concerned because I do not think this is simply a case of my "deposit Back" but all of the damages and the cost to re-do this correctly, which I contracted them to do, and most likely will include tearing off the entire roof including the decking and replacement of all Eaves and Fascia?
1) The roofing contractor at no point during the project discussed anything or any issues with me.
2) The field rep. was adamant that that my roof needed to be replaced BEFORE winter and it seems to me this was an "end of season" rush job.
3) I have running txt threads w/ filed rep and Owner since the onset of this nightmare project.
Any guidance is much appreciated. My home is in St. Louis City, MO.
Thank you very much!!

Worked under contract for 5 yrs. on project. I resigned and did 30 days. I was not paid final 2 invoices (about $30k). I read the statute to say that i'm a direct relationship and in Missouri do not need to give 10 day notice. Is that correct. My last day working was June 15, 2022 - almost 6 months. Is this the timeframe that i need to file the lien before next week? Can Levelset help? Then if they don't pay, i have another 6 months to foreclose? Just want to confirm my understanding. Mainly timeframe and not having to give the notice... because after 10 days, then i'd be past the 6 month point....Read More

We are a boyfriend/girlfriend contractor team who were hired to do a total home renovation and remodel in the state of Missouri by an individual owner. The owner did not draw up a contract and said they preferred a verbal agreement. Per the agreement, for compensation of the remodel, we were to be provided free housing and utilities on site the property we are working on with the promise of a rental property owned by the same person upon completion as well as daily compensation for food/materials/living expenses and the fulfillment of a paid invoice for the services completed. We have worked and lived on sight since July 9, 2023 and do receive mail at said residence. Payments have been spotted and sometimes completely withheld forcing us to aquire loans which are now unpaid. As well, the homeowner began entering our dwelling without notice or permission, rummaging through our personal items, and taking a very unhealthy interest in, especially the male figure in our equation, personal life and private affairs. Homeowner also began dictating how the earned wages should be spent opting to take us grocery shopping rather than paying us via cash, check, etc. After Homeowner became so engrossed in private affairs that she brought the male worker suppositories and demanded he gain a divorce in order to obtain the promised rental property upon completion of this job, the female in said partnership had a discussion with homeowner regarding professionalism and sat healthy and fair boundaries asking the homeowner to respect. Since this has taken place, the homeowner has stated "she doesn't like her anymore" and has attempted to retain the male both as a worker and resident in the home while kicking out the female without just cause or notice. The homeowner is refusing to pay the male until he gets rid of his female business associate and live-in girlfriend. Homeowner has even gone to the extent of contacting the ex boyfriend of the female, whom the female was a victim of abuse in said relationship, which was known to homeowner via intrusion of personal affairs, and allowed said third party to enter into the dwelling without supervision. Homeowner also gave third party access to the vehicle that was jointly owned by female and her ex to the ex boyfriend leaving female without transportation while demanding she be thrown out of property. It is winter and cold and with no source of compensation and no other forms of income, no transportation now, and no place to go due to not having relatives in Springfield area. Homeowner has not paid either party in 3 days leaving us without food or the ability to get any other needed resources. Homeowner is refusing compensation until demands that female, without just cause, be removed from property. Invoice for the cost of work completed up to this point have been furnished to the homeowner with refusal to pay.
What can we do? It's cold outside and we fear being made homeless by this woman. She also sold the property promised to us upon completion of this project. As well, she bought a trailer and put it in the backyard of property where we work/live with a homeless man she just met occupying it to keep tabs on our coming/going. She has illegally connected shared power to this trailer and is now attempting to make us not only cover our own utility payment, but also that of the man she moved in. Person is suspected to be a drug user and does not have employment but receives shelter and money from homeowner. We are desperate to gain some insight as to our rights legally in this matter. She has been a constant source of harassment via telephone and in person visits on nearly a daily basis, screaming matches, slandering and falsely accusing female of things both professionally and privately, has threatened to call the cops on said female, and do whatever is necessary to make her life a "living hell" all the while encouraging male to join their alliance and break off all contact with female counterpart. Female feels discriminated against with just cause. Any information would be greatly appreciated. ...Read More
I’m an owner of a painting company and a customer has signed my contract stating that we have to complete applying metal siding to all sides of the house vertically, and to install the vinyl soffit and then finally install a 16-18 ft ply board of facia to the front of the house. I am a contractor that has been working on an apartment pool deck. We completed job and were refused payment until minor corrections were made. We made the adjustments and were given bigger list. We began work to patch and they discontinued communication with us and are only talking with the product supplier. After he left they cut off communication mid repair. Can I still file lien with some work that needs to be done. ...Read More
