On January 1, 2021 a contractor came to our home and replaced our furnace for a cost of around $6000. We have been making payments and about $2100 is due. HOWEVER, the company filed a Mechanic's Lien on June 18th for the remainder even though we have been making payments. We have no contract for a timeframe within which to pay in full and I have read Indiana State Code 32-23-3 which states that "the filing of a notice to hold a mechanic's lien in Indiana must be completed within 60 days after the day on which the lien claimant LAST PERFORMED LABOR OR MATERIALS at the home." I would like to contest/remove this lien. What are my options?...Read More

I am a Licensed GC, working an insurance claim. There were multiple trades on this project, Roofing, Siding, Gutters, Window Trim. The roofing portion was completed by my roofing crew, the homeowners are/were thrilled with the way that it turned out, and that I was also able to supplement for complete siding replacement and able to get this approved by Insurance. Roof Completed June of 2019, homeowner requested that I wait for him to have new windows installed. Time passed, no windows... months passed minimal communication regarding the continuation of the project. Homeowner, decided to act as the GC and have his siding installed and his gutters and downspouts installed. The job is now complete, and I have been shorted out of the work and from any and all supplementals. Homeowner no longer speaks to me, no returned calls, emails or texts. When I worked toward final collection, final invoicing of Homeowner (Insurance) for the services which I have been provided, Insurance/Homeowner have refused to discuss the final invoice and the final supplemental funds requested for missed and shorted items. Homeowner stated that he was hiring an attorney, and I said "Good, maybe the attorney will advise you to fulfill the contract agreements that you enter into. From my invoice, from June of 2019, Insurance has shorted the claim by $6K ... from my May 2021 Professionally handled Xactimate - Invoice & Work Completion Notice the shortage of the payment / claim is closer to $12K I had assumed 2 years from the date of discovery / approval of claim... however, Insurance states repairs are to be made within 2 years of the date of the loss. To which I stated, "OK, then, let us discuss the final estimate/final invoice which has not been paid from June of 2019." Adjuster said, we cannot discuss this further without the Homeowner's approval for us to discuss. Can I pursue this and should I pursue this? A septic company is threatening a mechanics lien on our an Indiana County property, as we have not paid the bill of $980. The septic company was hired, by us, to perform a County inspection, necessary for "transfer of property". The inspector, from Septic company, performed the inspection on April 21, and stated our septic would pass inspection, after the d-box lid "cap" was replaced. It was thoroughly broken, when uncovered. (broken by the inspector while digging, but unproved) The inspector, of Septic company , said they could replace the lid "cap", and then send in the report to the County, and everything will pass..The inspector said it would be "inexpensive" to put a new cap on the d-box. We gave them oral permission to replace the cap (only) and then send in the report to the County Health Dept. The house is vacant. Unannounced, and with no authorization nor notification, the Septic company, same as did our inspection, came to the house on May 1, 2021, and replaced the entire d-box and charging us $980 for this work. I am an Electrician. The customer wanted to do the work. The work went from 6 feeder terminations to 6 terminations plus a new swimming pool. After the rough inspection the inspector wants a final on the swimming pool. This requires more work and trips for the job. When I let someone o their own work it is a minimum of 3 trips, i charge $50 a trip. Customer said he was ready for inspection I inspected and he was'nt ready requiring return trip plus trip for final if he's got it right. a Contractor recorded a mechanic's lien in Indiana for $5,723. The owner turned around and filed suit alleging various things, but also engaged in a written undertaking to post a surety bond to discharge the lien. The lien amount does not cover the attorneys fees expended thus far to collect on the amounts due to the Contractor. Also, if the surety bond is approved by the court then what do I do? How much should we ask the court to approve the surety bond for? Won't there be more attorneys fees after the surety bond is approved and we need to pursue the bond under a breach of contract claim? ...Read More
