I am a home owner in Indiana. I have signed a contingency contract with roofing company. Roofing company never return signed contract back to me and they helped to process the claim with an insurance company. Insurance company not approved 100% estimate provided by roofing company. They have rejected contractors overhead and profit charges due to not complex project. Roofing company asked me to hire a public adjuster and i refused as it was not mentioned in the contingency contract. I told them to cancel the contract based on insurance not approving their O&P charges. Now roofing company is threatening to file a lien on my property as i am not moving forward them. They are asking $2000 for cancellation fee and few emails they sent to insurance company. They have not performed any work , not provided labor or material . Only they sent few emails to insurance company to get my overall claim approved. Please let me know if roofing can company sue me and what are my options. Thanks and appreciate your help....Read More

Hello I am having a home built by a developer in Monroe county. I will have no involvement with the developers sub contractors nor make any direct or joint payments to them. Since I am not involved with the subs at any level do the subs have any legal rights to file a lien against the property after we close with the builder? I asked the builder for waivers of liens for each subs work but he is reluctant to do it because it is to involved. I could ask for a clause in the contract for the builder to state that all subs are paid in full but i don't know if that will do any good. Thanks in Advance Tom...Read More

Hi, i worked for 2/3 years at this place installing perfect epoxy floor/wall systems. every job they gave me i gave great deals with the highest of quality possible. They had a very large project that they could not find any one capable of doing after 4 years of searching. I was there and i told them i could do it, i showed them a sample and they loved it. A year later and during the covid bomb on our country, i was able to start this project. However COVID took its toll on me along with everyone else. After giving me the project i couldn't start it for almost 2 months later as i had covid and was down. Long story short... the let me get within 24/48 hours before they terminated my project owing me $21,000.00. They threw me 7k and told me not to come back. I figured its because they have a maintenance guy that could do it very easy now that i did all the hard work. But, seams one of my guys got in under me that i trained and gave them a better price. I hired a contractor to put in two basements for me. There is no contract but he gave me a bid of around $66k on one basement and $43k on the 2nd one. He was to have the work done in approximately 3 to 4 weeks. He had multiple no-shows and 1/2 days and etc. so we are into week 9 plus. He sent me an invoice for both lots and both invoices were for over $20K additional then the bid. He has not supplied any details or etc and is asking to be paid within the week or file a lien. I told him I need a breakdown of cost and there’s no way he can raise the price over 40% on each basement but if he can provide the breakdowns and there are legitimate extras I will pay them but I need the job finished. He agreed to send details but I have not heard anything back from him. What are my rights to stop a lien and not pay $40K plus over what the bid price was?...Read More

I was a renter to the home I am living in now. But come to find out the person who gave me an my wife a fake contract. Say she was the home owner. We was buying the home on land contract. We gave $5,000 down. The home was not liveable at all. We put another $13,000 in to it with than a 2 year time frame. But the we found out she was not the home owner and been here in the house for (4years now. Last week someone else stopped by here said the had the deed to the house and the bought. So I sent a letter up to my local court house asking for a hearing about the house. So they said I had to write a pelmenarily letter explaining why I am asking to do so. Then a week or so later I get a letter in the mail saying they will let me know when a court date is scheduled so I can explain my side of this issue.. so what can I do about this ...Read More

What happens after 1 year if they never pay ? IS a lien actually worth the time and money WE have to pay on top of not being paid, if it only lasts 1 year? What if they don't sell their house? We just continue to go unpaid, and on top of that now we've paid for the lien as well. ...Read More

The state of Indiana. I provided architectural services to a contractor for work at a residential home. The contractor paid me my $1,000 retainer. This project started in August of 2021. I provide preliminary sketches to the contractor. After modifications, we made final drawings which were provided to the contractor for use on Sept. 28, 2021. To date, I have not been paid the remaining $3,000 owed. I have sent multiple notices by email and text. I gave him an ultimatum of today (12/2). He says he has been paid but checks need to clear and is going to pay me tomorrow (12/3). I told him if it is not paid tomorrow I will take the next steps. I will file a lien on the homeowner's property. I have to go out to the property on Monday to take photos and check on the construction status, which will include me filing a field report with him and the owner. A contractor hired to perform tile work did an extremely poor job. The tiles are not installed correctly and look like garbage. And they didn’t complete all the work that they were hired to do. We got fed up and told them to leave the job. They sent an invoice for the total amount due if they completed the work properly and all of it. we paid over 1/2 due and deducted for the poor workmanship and incomplete work. The roof was replaced through an insurance claim on a home we're buying. We are supposed to close on the home this week but it has been disclosed that the insurance hasn't fully paid for the roof yet and we know the seller is financially broke. We have submitted a pencil bill (preliminary bill) to the customer for approval. This is our step to gain agreement from the customer before posting the actual bill in our ERP. The GC has not been very responsive in their approval causing a delay in billing and ultimately causing delay in payment.
