I had an individual send me a check and I deposited it and it posted to my DDA same day for $18,900 and then we did the job… so paid guys and for materials and so on. All together let’s say $11,000 was put out. 5 days later the money is taken from my account and it was showing in there previously. I go to the bank right away and they tell me that there is nothing they can do cause that check was written from a closed business account and Then got a copy of the check in the mail So I immediately filed a 10 day intent to lie. But that really hammered us and I feel like I’m getting jerked around here and then the lady that the check came from calls after she received the letter and she says that’s a fraudulent charge with a stolen check and idk what to believe and I certainly don’t want to go after someone if they are going through the same thing as me. On top of all that we’re doing a merger with a historical roofing company and now we look like a couple idiots I’m sure. First I am in ILLINOIS in Cook county. I entered an agreement to loan money to a company to rehab a two flat July 28, 2021. I signed an agreement and notarized a “notice of lien” that the person was to file. I have a copy of the notarized lien document. Months later, I still do not see the lien notice when I look up the property. The project is well past the expected time frame of 3-4 months. I inspected the property two weeks before Christmas. It needed about three more weeks of work to close out in my opinion. A buyer is in place and approved but no closing date. The person called me multiple times a day to obtain the funds but is slow to connect now that payments are due. I have requested a portion of payments on two occasions to show good faith. I have received nothing so far. How will I collect on my investment? If the company dissolves am I out of my investment or will the buyers have to pay what is owed? I set up a notice to lien document to take to the courthouse downtown. What are the final things to check off on the list before I go there? And will I inadvertently kick off a whole new set of systems if I do so?...Read More

We delivered panels to a customer on 10/09/21. He had issues with his order so we advised him to send them back so we could fix it. We delivered a crate to him to return the panels on 11/13/21. Unfortunately, we did not send a preliminary notice as he had already paid in full. He never returned the panels and never contacted us. Now he has retracted his credit card payments and we are past our deadline to send the preliminary notice. What are our rights at this point since he has retracted his payment but still has the panels?...Read More

Hi, I signed a contract with a local roofing company in 2021, and the contract specified 16 work items. The roofing company sent me the certificate of final complete, which certified that all 16 listed items were completed per code requirement, and the contract end date is September 3, 2021, the remaining balance is due by October 3, 2021. I did a partial inspection with help of a Illinois License Roof Company, the inspection showed that at least 4 items were uncompleted. The contractor attorney sued me in County Circuit Court for the remaining balance. I am planning to do followings; 1. File counterclaim to get deposit and additional costs ( legal fee, inspection fee, court filing fee) back from the contractor. 2. The reason for Item above is The contractor violated (815 ILCS 505/) Consumer Fraud and Deceptive Business Practices Act. (815 ILCS 505/2Q) (c) A person engaged in the business of home repair, as defined in Section 2(a)(1) of the Home Repair Fraud Act, who fails or refuses to commence or complete work under a contract or an agreement for home repair, shall return the down payment and any additional payments made by the consumer within 10 days after a written demand sent to him by certified mail by the consumer or the consumer's legal representative or by a law enforcement or consumer agency acting on behalf of the consumer. I am a property owner of an apartment building in Illinois, one day i got a Notice of Intent to File Mechanics Lien When i called the company who send the letter, they said they provided board up service to one apartment, but they don't have any documentation of the service agreement or contract. I have no idea about this work being performed, I never consented to the work performed neither written nor verbal. Can the contractor still proceed to file the lien? If that is the case, can any stranger perform work whether requested or not, and file lien to be payed for it in Illinois? ...Read More
