I worked for a client for about a year . She always had good checks. During the time I was working with her she became ill. I was working in the day and caring for her at night. The work was remodeling various parts of her house. The last two checks she wrote were returned. Meanwhile some distant friend of her late husband got her to appoint him power of attorney . And refusing to pay the check. Her house is paid off and she has plenty of money. He’s not paying in hopes of inheriting all her assets. She has no family. We were terminated on our MSA with a general for convenience, the owner had another company he wanted to do the work. We are halfway through the project located on a mountain in a ski resort. We were the excavation company for this project. We have been installing large retaining walls, utility lines, and foundations for a condo project. We have been asked to refund the portion of the deposit we are still holding. Is there any way to protect us from any further warranties on this job since we did not get to finish it? Should we remove this general contractor as an additional insured from the day we left the job from our insurance? Or do we leave them as additional insured? ...Read More

Hello! We completed a portion of a contract job in Idaho. I billed the contractor who hired us on August 11th and inquired a couple of times about when to expect the payment. Each time he said he is still waiting for a draw from the bank. I just heard through the grapevine that he is in a bad way financially and multiple jobs have his have came to a halt. I gently reached out to the homeowner of the property we are working on to gauge the situation. ( I had worked with her directly on a couple details of the house) She informed me that the contractor had not paid the truss bill and the truss company had placed a lien on her property. She also informed me that he has only taken $2500 in draw towards our invoice of $20,000. In other words, technically he hasn't been paid for our portion. She said that all draws have been stopped and they will no longer be giving payment to him. I discussed with her getting my portion of the work paid for directly from her, as she hasn't paid for that portion yet. She then informed me that the budget amount that he had given her from plumbing was $12,000, however, our full contract is for $27,000. So now she is questioning how to pay the $20,000- as she only has a budget for $12,000 and has given him $2500. She directed me to contact her attorney- as it mostly seems she doesn't know what to do with the situation. I have reached out to her attorney twice but haven't gotten a response. She has a meeting coming up with him soon and she hopes to learn more at that time. My question, what do I do? Do I wait it out a week or get a lien issued right away?...Read More

We have a new construction residential build. At the recommendation of friends, we chose a different stonemason than our GC usually uses and we have been managing him directly. We have no contract with him. We signed the original estimate of $17,500 and paid a materials deposit of $8,000. Issues with the workmanship occurred and he became very defensive and difficult to deal with. Everything from that point forward occurred through email, with his girlfriend we think writing them. They proposed a final price that included a discount of $2,000 and we agreed to that amount and they termed it the "the final price of the project is $13,752." This is in addition to the $8000 materials payment we had already made. He then finished the rest of the project. We asked for receipts for all the materials and in gathering those he realized the materials cost was $2500 more than he had factored into that "final price of the project." He said he was unaware how much the difference was until then and demanded we pay for it. We negotiated some of that down, but he is still pushing back on more of it and we feel we have used good faith but are no longer interested in negotiating with him. We did not agree to any cost overruns in advance above the $13,752 + $8,000. It feels like the extra materials is a bait and switch. We want to push back and say that the only thing we agreed to was the $13,752 and that is now all we will pay. However, we are concerned that he will put a lien on our build if he does not get the full amount he is now demanding. Negotiating it down, it sits at $1,000 more than the $13,752. So we are talking about not that much in the big picture. We also simply cannot afford to get into a legal fight with him or deal with a lien waiver. On principle, it feels wrong to cave to his demands (especially given his tone and previous conduct), but we also do not know if it is worth the fight. I have multiple debilitating health issues, am recovering from cancer and we are trying to finish building a home with my husband doing most of the remainder of the work himself. We have a lot of other things to be doing with our time, energy and money. So, we are trying to determine if there is any wisdom in pushing back and saying we are not obligated to pay for any costs above what we agreed to at the $13,752 balance due. So I suppose to make a better decision, we would like to know: Without an explicit contract, are we legally obligated to pay for anything a tradesman brings to us after the fact that he did not disclose and get approval for in advance? I have not been able to find a license number for him. Are stonemasons in Idaho licensed? If not and he does not have a license, can he file a mechanic's lien? We are trusting souls who clearly made a bad decision. We just want to be treated fairly and find peace with all of this. Thank you for any help or guidance you can provide. I PAID A GENERAL CONTRACTOR FOR A PAINT JOB (LICENSED/REGISTERED) IN IDAHO. HE HIRED A SUB-CONTRACTOR, UNLICENSED...NO PAPERWORK. THE JOB SHOULD HAVE LASTED 3 WEEKS, INSTEAD 3 MONTHS. I BABYSAT THE JOB WHICH WAS FRUSTRATING, THE GENERAL SHOULD HAVE FIRED, WHICH I RECOMMENDED. GENERAL IS ON OTHER PROJECTS. I HAVE A PAPER TRAIL, GENERAL PAID IN FULL. THE GENERAL WAS IRKED AT SOME OF THE WORK BY THE PAINTER AND NEVER PAID HIM. I HAVE A BUYER FOR THE HOUSE, IT HAS A LIEN FROM THE PAINTER (UNOFFICIAL DOCUMENT). CLOSING IS JUNE 10, LIEN EXPIRES JUNE 20. LIEN WAS TEXTED TO ME ON DECEMBER 20 FROM PAINTER...I COMPLAINED TO GENERAL HE SAID LIEN NOT VALID AS IS AN UNOFFICIAL DOCUMENT NOT A JUDGMENT AND PAINTER HAS NO LICENSE OR PAPER TRAIL. MY QUESTION IS CAN THE PAINTER RENEW HIS LIEN ON MY HOUSE? THE GENERAL AND PAINTER WERE SCHEDULED FOR SMALL CLAIMS COURT A COUPLE OF TIMES. ALL COURT DATES HAVE NOW BEEN PUSHED TO AUGUST BECAUSE OF COVID19. I'VE BEEN BACK AND FORTH WITH GENERAL, WE ARE PLEASANT (THEY THINK LIEN NOT VALID). IT IS VERY SERIOUS WITH THE TITLE COMPANY INVOLVED. IT WAS MENTIONED I COULD PAY THE $4300 AND TAKE THE GENERAL TO COURT. I had signed a contract with my uncle pertaining to a campsite restroom my company was hired to build. we were responsible for all phases of the structure. after grading, forming and pouring the structures footings and concrete slab, i realized i under bid this job by alot of money. I am a newer contractor and had a few older contracting buddies come and give me advice on what i should do moving forward with the project. all of the contractors who had came and looked at the job advised me that i should writte a new proposal asking for more money to work with, as the footings and slammed eat up most of the down payment. one contractor even told my uncle that i had slit my own throat on this job and to work with me as i am family, well he did not listen and when i asked him for a bigger deposit he refused and fired my company (which he had hired a bigger contractor who charged him double my price. when he asked for money back i told him that i would be happy to finish the project but he would not be getting 30,000 back as i only had 20,000 in a deposit. since, he has hired a lawyer to try and get money that is not there. the lawyer advised me today they will settle for 25k i do not want to pay him anything as him and i both know i underbid that project. he told my aunt that this is a learning curve for me that is why he is suing me! I am a general contractor who at one point used a company who sent us referrals. We cut ties with that company because they refused to enter into a contract with us (so there is no contract), they used stock photos instead of actual work, and they misrepresented services that we could do. They never did any actual labor and again, there was never a contract in place. Most recently, they referred us to a job and when we got there, we realized what the promised could not be done. We declined the job. The homeowner then changed what they wanted and worked directly with us. The referral company is now demanding payment, and threatening to file a construction lien. Does a "consulting" or "estimating" firm have rights to do this ? Again, they have never performed any labor or provided material....Read More
