Hi, We have a customer who frequently does not provide any payment remittance when sending us a check. Are we able to apply payment to their oldest invoices or do we need to wait for them to tell us how to apply payment? We have repeatedly asked for remittance and received no communication. We have 2 projects in Georgia right now. Payment is about a week late for 2 invoices. We also submitted a pay app on 11/15 for approval last month for work through 11/30 and still have not received approvals or feedback. Management wants to file an intent to lien tomorrow. Is this possible? If so, what needs to be done? Can you also point me in the direction of a good source for research on GA lien laws? Thanks!...Read More

We are a demolition subcontractor, typically work for GC's who are doing construction on behalf of an Owner. I am unclear on what type of Levelset notice I should be submitting. Levelset offers: - Preliminary Notice of Lien Rights (Filed - Not General Prelim) - Non-required Preliminary Notice 30-day Date, and - Notice of Commencement In order to protect lien rights down the road, we've been doing the Preliminary Notice Filed option. We are a company that hired a contractor to manage a renovation on a building that we purchased. We have received notices of liens against the contractor for our location. The contractor shrugged it off claiming that the lien notice was part of the invoice process for payment. We received another one since the discussion, and this time it looked different. It was actually filed and canceled once payment was made. We have not been able to contact the contractor since. My question: Is this a normal process, to file liens for payment? Or is this the step taken when the contract manager has not been paying his invoices? We have discovered that another big invoice was not paid dating back several months.
