Contractor had major delays on a project due to internal issues on their end (not due to any subs). They are still having delays and the job is completely stopped, but we have been ready to finish for months. They have held over $50k of retention for over 14 months now due to their delays; Do we have any rights to demand these retained earnings? Or at least a portion of it? My family received a mechanics lien from a construction business we have never worked with. When we reached out to the business to get details on the work they believed they had done, we received no response. I have completed a notice of contest for the Georgia clerk's office but I want to make sure I submit to the necessary parties. Should I submit it to the clerk's office only or should I send a copy to the business' address on the lien? Also, what steps should I take after the 60-90 days if no response has been received? We paid a general contractor for some residential construction. It was to finish a basement. He started the work in March of 2021, but has not touched the project since then. He keeps coming up with all the excuses of why he can't finish. But basically, He spent our money on another project, instead. I hired a contractor to remodel my apt. back in June 2019. Although a list of services were discussed and agreed upon, no contract was given or signed. The work was done but not completed and some of the work was performed unsatisfactory. The party was notified of the shotty and incomplete work but the work was never redone or completed. He filed a lien in Nov 2019 which was then followed by a lawsuit in March 2020. Papers were never served and the case was dismissed early 2021. I went to sell my apt. end of 2021 and he tried to sabotage the sale by his attorney contacting all parties involved letting them know there is an outstanding lien and lawsuit and to cease and desist with the sale. To preface this, I was not aware of the lien or the lawsuit until after I had a contract on the apt. I had to bond off the lien in order to close which cost me almost $14,000. Also, the amount of the lien was considerably more than the balance I allegedly owed. I know there are laws against unlicensed contractors performing certain services (plumbing and electrical) and over a certain dollar amount (I believe $2500.....job totaled approx. $20,000) of which he has performed unlawfully. Also, I am aware there are laws governing unlicensed contractors filing a lien against ones property. Although I would be in my right to retaliate for all the grief and aggravation and expense he has created, I just want to get the invalid lien removed and get my money back for the bond. I was in the hospital with COVID breakthrough and in a coma for three months I had a flood in my home and the contracted midigation company sent me a notice of Lein and I didn’t get it till just now. I’ve tried reaching out. No resolve. But because they are charging more than my insurance is allowing to pays. I don’t feel responsible for that. They left equipment four humidifiers and normally each one is a charged for three days. They finished the clean dropped them off and I told them to come get them. They didn’t They also said don’t worry about it. Get well. Then I was waiting for clearance. This was at a time I was sick and required surgery they never got them. Then I caught Covid and was in a coma for three months. I come home to this. I don’t want to lose my home. Ans I have the allowed money from the insurance but I can’t pay them anymore than what’s allowed and agreed. I also caught leukemia July 2019 and I told these guys I was in no rush. I can’t take the stress I’m going to die and so is my 78 year old mother who lives with me.I like to dot my eyes and cross my tees. They gave me no time to get documents together. I am being threatened with a lien by ex boyfriend. He acted as General Contractor and hired subcontractors to do some work. I never hired anyone directly and there were no contracts signed. I'm a material supplier who supplied material to a contractor. The contractor (our customer) had a contract with the City of Cordele in Georgia. Somehow, the city forgot to require a payment or performance bond. The city attorney says we cannot file a lien against the city. Is this true? Optionally, any advice on how to get paid? Sold the job to the a women and her father in law. I learned later that the father in law does not live at the residence anymore. When it was time for payment I was given a partial payment and told to come back next month. It is now time to collect in full and I am not getting any response from either of them. I hired a company for a major basement refinishing. After paying deposit I found out they are not a General contractor but a glorified project manager. Long story short, are they or the subcontractors they hired able to place lean on my home?? I only have an invoice from PM, no real contract, and have never even spoken to subs who performed mechanicals on basement. I am a new franchise owner. We remodel bathrooms, mainly showers. I have a customer that is dissatisfied with his shower door. We have replaced the door twice and he is still dissatisfied and refusing to pay for the job. We installed flooring, built a shower and installed an upgraded door, followed by a replacement door of the same brand, followed by another door chosen by the customer. The final door needed adjustment and a custom shower door company was sent out to assess and adjust, as the customer was still dissatisfied. The customer now wants a custom shower door installed by the company we sent to assess and adjust the door. That door cannot be installed until January 7th. We completed the initial work on the bathroom and invoiced on 11-11-21 and have been attempting to satisfy this door issue. The customer points the shower head directly at the corner of the shower door where the hinges are when he showers, I guess it is preference however the first 2 doors were frameless and that is an impossible problem to fix given his showering technique so he requested a framed door and we are still not getting paid. The cost of the custom build is $700. Are we allowed legal to demand payment for the rest of the project?...Read More
