We hired a handyman to do work around our house, but fired him due to prolonged finish times and things getting started and not finished. He damaged some walls and ruined carpet in a room. He also completely broke out attic ladder. We have hired a GC to repair and finish the work. The HM is now asking for $7400 more. He is charging twice for the same work and for work not completed and work not started. What is our recourse in this situation? I’m being warned he can file a lien. Some research on this HM shows several news articles where he has scammed other homeowners and has posed as a GC. We only received 1 invoice from his wife (realtor that brought him into the situation). There was not a contract or anything else given to us. He gave verbal amounts except for the one invoice....Read More

I run a staffing agency and I provide a maintenance technician for this property management company. They are $9700 in arrears. I do have a credit card on file and the company has agreed to pay in $500 increments every two weeks until they are paid up and will pay sooner. Dispute with fencing company, they measured inaccurately and then dug up and moved fence. I initially refused to pay balance and filed small claims. Received notice from their attorneys to make payment within ten days if not they would go to court and file to force a foreclosure on my home if I took the case to trial. I paid within the 10 days but received another notice stating they would cash my payment if I paid part of their legal fees. They have been holding the cashier's check for over 60 days and insisting on going to trial to force foreclosure and dismiss my small claims. I now have to hire an attorney, after they filed a motion to transfer from small claims to civil court....Read More

I recently purchased a mobile home and had it put on my daughters land. The manager where I purchased the mobile home, added 15k to the amount of the home for a well and septic and advised me not to tell the finance company. He now has come back and stated I owe him $3500 more on the well and septic and if I don't pay it immediately he is going to file a mechanics loan on the property. I have asked for receipts/invoices from the installation of the well and septic and have not been provided with either. There is no contact pertaining to the well or septic and the property is not mine. Can he file the lien on the property?...Read More

We have been terminated from our contract on a large commercial project by the general contractor. It has been a strained relationship from the start of the project. We were 95% complete and we had an issue with paying employees for one week. Payment was quickly resolved but the GC inserted themselves into speaking directly with my employees and even offered them jobs to complete. This caused a number of them to leave the job because they wanted no more to do with the GC. The GC then issued a Notice of Cure because we were short staffed. The contract states we have 5 working days to correct. On the 3rd day they terminated our contract. There is money left on the contract and vendors need to be paid. ...Read More

This is a Florida Re-Roof in Polk County Florida. the contract calls out the contract amount, that was signed by the property owner. The lumber that we discovered was input into a change order and due to the fact that we are unable to obtain approval for the change order at the time of the roofing being removed and repaired. We have the language in our contract that specifies this as well as the lumber pricing by piece or linear ft. When creating a lien for the property will the contract language and change order that is not signed by the owner hold up in court with substantial imaging and documentation of the lumber costs and replacements?
