Hello,I received a Mechanics lien on my property by Ritz Craft Pools and the reason why there is still an outstanding balance is because the work has not been completed. My reference number is 10161934. The reason that this is an issue, is because Ritz Craft did not follow the scope of work and get the power for the lights from the breaker panel that was designated for the lights and instead took my sprinkler well pump power and used it for the lights and that left my well pump without power, so now I have no sprinklers to water my yard. The result is that Ritz Craft has to run a new power supply from the breaker panel that was designated for the lights out to my sprinkler pump to restore power, that they decided to use instead of what was designated for the lights, this will involve removing pavers that were already installed and digging a trench out to the pump pad, lay the piping, pull new wire and connect it to the breaker in the panel that was originally designated for the lights and replace the pavers. Ritz Craft is well aware after discussions that we have had about that issue and a few others that still aren't finished. They have concrete over spray all over the house wall, windows and doors, they came out and cleaned one area off and said that they are finished. I did show them pictures of the unfinished walls and they still have not come back to finish cleaning the concrete off of the walls. Ritz Craft knows all about these issues and I have stated to them that once the work is completed that I would make the final payment and we can be done with this, but they decided to leave the work unfinished and put a lien on my property because of their lack of professionalism. I worked (drafting) on multiple projects for a Florida tile contractor with a standard practice of holding a retainage on all projects. I finished work in 3/28, Invoiced on 4/15 but my invoice wasn't denied in writing until 8/31. I was basically strung on through other projects with "we'll get that payment next month". We are a subcontractor in Florida with a direct contract with the owner who was also the original general contractor. The original Notice of Commencement did not have a general contractor listed. We filed a Mechanic's Lien on the owner for not paying, listing the correct owner that we are contracted with and stating that the owner is also the "hiring party". After our lien was filed, the owner filed another Notice of Commencement listing a general contractor. We do not have a contract with the new general contractor. A mold mitigation contractor was hired and authorized to charge my insurance during a water damage claim we opened. They contacted us for payment after work was done and we explained they had to charge the insurance directly. We filled out a form for them consenting them to charge our insurance with all the information needed. They followed up about a month later asking for payment again with an Intent to File Lien, we replied saying they have to charge insurance not us. Now almost a year later, they contact us again, it appears they never received payment from my insurance and now they are demanding us the client for payment in the next 10 days or they take the necessary legal action to collect the remaining balance due. I signed a contract with a Roofing Co. and my insurance awarded the repair to another Contractor. I learned there is an Atty representing the Roofing company I signed with. I even tried to convince my insurance company to give the work to the Roofing Co. I signed contract with. But Insurance said they have a set of vendors they use to make repairs. I know for a fact that such Atty was notified by my insurance and is copied on all the communications sent to me by my insurance. Can I be sued by the roofing co, if I go with the approved contractor to my claim? On a second thought, the Atty has not contacted me but only a lady from the Roofing co., stating they are still working with my insurance even after I told her, the claim was awarded to another Contractor.
