Claim of Lien was timely filed and notice sent certifed mail to owners address shown in the tax records, sender received a signed return receipt, the defendant owners raised the issue in their original answer; but dropped the lack of service claim in their amended answers. On Plaintiff's Motion for Summary Judgment the Defendants argued they never received the Claim of Lien. Under contract, my Contractor has failed to complete the job not only in a timely manner, but at all. He told me it would be completed by last Thanksgiving, 2021. Any correspondence results in a 2-3 week lapse in any further responses, always initiated by myself. Now my Homeowners Insurance is threatening to cancel for incomplete work. He has basically abandoned the project and the work that has been completed is shoddy at best. I was told by my insurance agent that I could put a lien on my contractors business. I bought a food product that turns out to be different than what they say it is. I filed a complaint with the company and put the complaint on my Facebook page so people could see whats going on with this food item and I filed a complaint with FDA. the company apologized for the item and sent me a coupon to buy another . when I told them I didn't want their coupon as I have no intentions of ever buying their product again and I requested a refund instead. they said ok, but I had to sign a release to get a refund. We are having a problem getting our vendors to sign our conditional lien waivers for progress payments. We request a lien waiver be signed, however, they have been refusing to sign until the get the check. Unfortunately, our owners and CFO will not allow us to mail a check without a signed lien waiver. We've started encountering "stand offs" with several of our vendors. What can we do to prevent this situation? I've explained to them that the release is conditional and effective only on the claimant's receipt of payment. This is the general type of response we receive "we do not sign any waivers until the payment has been received. Our corporate policy is the same for all branches regardless of where the materials were shipped. Due to lien release waivers differing from state to state we request our customers send the waiver with the payment and not before, we will not sign any waivers until the payment has been received. This applies to all lien releases final, partial, conditional, and unconditional releases." ...Read More

My husband and I are licensed in FL for Handyman work. 2.5 years ago we moved into a non inspected pole barn/Kwanzaa hut, in disrepair. We were told by the acting landlord verbally that any work done to the structure would be taken off of our rent and then later by the owner verbally told us to do whatever we needed to do to make it livable. We have an extensive list of labor done, from painting to electrical work and materials used over the span of 2.5 years. We have never received a lease agreement and the owner denies the work against rent claim made by the acting landlord (her cousin). The owner is now evicting us due to a pending sale on the property. Can we file a mechanics lien for any of the labor/materials if the owner did not file an NOC? Thank you. ...Read More
