We fired our GC last summer after we became fed up with project delays and the poor quality of work. He performed general construction, electrical and plumbing work. I have asked for and not received copies of his licences and insurance. I cannot find a GC license in the name of his company on line. I strongly suspect that he is not licensed and neither were the sub contractors that he used. Communication came to an end before Setpember. Recently we received notification that he has placed a construction lien for $1000 on our home yet it was filed almost a month prior to this notification. We did not receive a NTO or intent to lien although he claims in the lien to have sent one by certified mail. There are still issues in the home as a result of his work. We are going to repair these ourselves over time but I expect they will cost in excess of $1000 to resolve. Am I correct in thinking that the lien is invalid because a) no notice of intent b) over 90 days since work stopped and c) not delivered with 15 days of being filed ? This is aside from him possibly being unlicensed. What should I do next and what more can he do? Thanks...Read More

I'm converting our contracts to cost plus a fixed rate. When I send my employees to a job I want to invoice for our billable rate for that employee. I fear a difficult customer may say our billable rate is not the cost rate of my employee. Should I add a line to the contract stating: Customer will pay incurred builders costs for sub contractors and materials, and builders employees will be invoiced at a rate of "X" per hour. Hello, I have a mechanics lien for roof filed against my homestead property. I am in a chapter 13 bankruptcy and looking to convert to a chapter 7. My mortgage company has granted a modification agreement so I may continue payments and keep my home. However there is the problem of the mechanics lien. Hi. My company performed work for a large contractor in our area. The customer was very difficult to work for and to please. We finished 75 to 80% of the work before the contractor asked us not to finish the job. We were paid $3500 out of a total $5400. The contractor then took back the $3500 out of a payment for a totally separate job. Now he is refusing to communicate about the job at all. We worked on this job for 3 full days and completed most of the work. There were small accidents which we were not given the opportunity to fix upon completion of The job. We paid out of pocket for some of the materials and Dump fees. We also paid 2 separate employees to work on this job. Essentially we have now paid out $1000 to do work on this customer's property. We have completed our contract amount of 191,513.95 on a home damaged in Hurricane Michael The homeowner received 288,000.00 from insurance. The final inspection passed three weeks ago and the man assures us that the bank said the final funds of 78,000.00 of which 18,000 is to pay the public adjuster. will be available this week however he is indebted to us $125,198.00 and has not made a payment since September. Is there a form/contract that we can have him sign promising to pay the remaining amount due for materials and services performed?? Hello, I have a couple of liens and I would like to offer my customers a 50% discount. I am already losing money and I dont want to hire a lawyer because I just want to recover the costs. I moved into a new house and hired the landscaping company that works for the H away they were problems from the beginning which should’ve been a sign - they didn’t check the irrigation and went ahead and laid the sod the side all died they said they would go ahead and replace it because it was their fault and they also took a whole planting area out which they were supposed to leave so they really screwed a lot of stuff up - they replace the sod and put back the planting area as well as possible it’s still not the way that it was but I’m pretty much done with these people and now at the balance of the original bid there were no contract signed at all there’s $296 left - I had a gazebo in the back which had a Bougainvillea on it all I wanted them to do was cut the Bougainvillea away from the gazebo because they screwed up the job so much they did extra things and said we want to keep you happy we’re gonna do whatever you want so they went ahead and remove the gazebo without me even asking which I had my own guy who is ready to do that and they sent me an additional $600 bill for irrigation repairs that they did which not once did they say we’re going to charge you for these or give me a price or have me do a change order - they charge me for cutting the Bougainvillea back which they never told me they were going to do and also charge me for removing the gazebo which I have an a text they are guy said if we had charged you for this it would’ve been expensive so throughout all of this not one time did they give me a price or say you’re going to be responsible all they kept saying was we want you to be happy we’re going to take care of everything and fix our mistake for screwing everything up - they didn’t charge me for any of the irrigation repairs although I told them I had my own irrigation company if I needed to do that but they charge me for having the guys come over and talk to me to make sure everything was working etc. so now they’re saying if I don’t pay they are going to file a lien on the property - I come from family general contractor so I know quite a bit about noticed the owners and liens they never gave me a notice to owner the last time they were on the job was April 6 and the balance that they are sending me is $600 and there’s no contracts nothing was signed not one time out of that $600 bill did they say you’re gonna be charge for this on the original invoice I owe them $296 and they still have two plants they didn’t plant that are sitting in pots and they ripped out when they ripped the gardening section out they ripped out the border which was different pieces of wood and threw that out so they put just a plastic border in which they said they would replace once they found something so they’re really not even done with the original job but I’m done with them specially when they said they’re going to file a lien...Read More

We are professionals working on a small (single family residence) project where we have been left in charge of the entire project for the past 4 1/2 years. The owner was supposed to eventually occupy the property with us after his wife died and split the costs as payment for our labor and materials. However, after his wife died we received a notice to vacate the property. The owner refuses to communicate with us and has hired an attorney who also refuses to communicate with us but claims the owner wants us out. We have received notices from the owner but none of these has been signed. The attorney who represents him refuses to prove she represents him.
