home location - hillsborough county, florida. background - sept 2018. staging company put in so called home managers ( contractors) to live in the house (not their employees) . they are almost tenants paying the utility bills etc etc. they claim their furniture was damaged due to a leak. and when asked for a final invoice to settle there was no response. may 2019 - when selling the house we realized that there was a claim to lien for $4500. They didnt serve any payment invoice nor did they serve a notice and the claim of lien was from the staging company stating damage to furniture of the home managers . i want to contest this and not to stop the sale, i have transferred the cliam of lien to a bond. now along with the bond, i understand i can also file a contest notice and serve them 20 days to show cause. need help from a lawyer for this. ...Read More

I had a lien put on my house over a dispute with a renovation gone "bad". I requested they come fix the work and they wanted the other half of their payment - unwilling to fix the bad work they did. I am now looking at options such as contesting the lien. I do have a question - If I contest and they move forward with the "foreclosure of lien" lets say that they happen to win. Does this mean my house is foreclosed - or can we just choose to pay the amount due in cash after the court awards it?...Read More

My company is a Florida licensed underground utility and excavation contractor. We recently started doing commercial work which only includes “site work” and we have missed the 45 day filing requirement for NTO on each project. I have gathered that our line of work is exempt and can still file. Is this true? We performed renovations on a hi rise condo building’s common areas. Basically flooring wall and ceiling finishes and lighting in the hallways. The building is from the early 80s and they elected to refinish the old surfaces instead of replacing with new (unit doors, laundry room cabinets etc.) The condo manager, who is a young lady in her twenties, while trying to justify her position, has become extremely unreasonable with every little speck and dot on the walls, doors etc. and is holding back $16,000.00. We have been more than accommodating, sending the painter back 4 times as well as other treades tho address touch ups. Upon a recent visit to the sight, approximately 5 rolls of blue tape cut to 1inch pieces has been placed on the walls and other surfaces where she thinks we should fix. A roof contraction did not install my roof as per Florida Codes nor as per my contract and made a mess of my roof. I just had 2 Certified Building Roof Inspections and both state the same and then some, such as not installing as the contract stated with drip edge and vents. I sent certified letters demanding the work be corrected and completed but the contractor only wants my money. A subcontracted County inspector signed off on the job passing the roof, despite that he did not even go on the roof and inspect it and despite the disaster on my roof, gutters and downspouts. The Contractor filed a Lien on May 3rd but the notary signatures state, May 4th! and did not send me a Notice of Lien by Certified mail. I want to sell the property but I cannot legally and ethically because of the roof. I cannot hire the new contractor to replace the roof because of the lien. So if I can have the lien removed because of a technicality that there was no Notice documented or filed, then I can get the new roof installed and have the property "Bonded off", if I need to to sell it if the contractor puts another Lien on it. The /contractor hired a Attorney who has filed a Foreclosure Lien Nov. 30th. They did not serve me the summons which has expired as of March 2019. Now the controversial Lien that the contractor had recorded in May 3 2018 will expire in 2019. So I was wondering how that effects this case? And since the Notary was dated May 4, 2018 which is the day after it was recorded? I just want to get my new roof installed before I have to go to court that shows I needed to get a new roof and that I can sell it. I am trying to negotiate a settlement with the contractors attorney to pay my damages that are now over $15, 000.00 with the extra $8,000.00 difference in the cost of the new contractor roof to be installed. This does not cover any other unforeseen damages that the roof contractor caused to my under area of the pan roof. This roof contractor only wants money and abandoned the job. I have a letter prepared to send his attorney. Are you allowed to review the letter? If the attorney refuses to settle out of court, I am now prepared to go to court to settle this and get paid for the damages. The regular Lee County inspectors have refuse to come back for over a year and reinspect my roof, despite all my emails and calls and mailed letters with the photos of the major problem areas. They just ignore me and/or refuse to come and properly inspect the roof that has big 4" x3" holes in the sides, and rats entered and went into the wall, and the wind blows up under the TPO roof and sounds like snap crack pop. It is all so pathetic and ridiculous. I reported it to Florida Dept. of Business and Professional Regulations and The County Commissioner and they just push me to the side and say they cannot do anything. So I am very aggravated and frustrated at this point, when all I wanted was a new roof, but I got what looks like a big diaper on top of my house. This roof situation is ruining my life and wasting my time and stressing me out to the point of who knows. All, I just wanted a new properly installed roof and to pay for it. I need to get the inspectors to come back and resend the "pass" to a fail. So how can I get some Governmental force or law action to make them do that. I will have the Professional Roof inspections with the codes. So who can I contact who would make them realize that this is a serious matter. We financed a water purification system in 05/16/2016. The work was completed on that same day. We had some financial issues and had to file for a Chapter 7. We obtained counsel in 12/2016 and this company that financed our water purification system was included in the filing. Our discharge was 10/04/2019. We placed our home for sale and closing was going to be later today, 04/29/2019. The title company notified us on Friday 04/26/2019, of a 2nd mortgage listed on the title settlement statement from a 3rd party biller. We were shocked and had no idea about any such 2nd mortgage. We found out yesterday, 04/28/2019, through a Osceola Co. Florida e record search, the company that had financed the water purification system filed a mechanics lien/UCC Financing Statement with Osceola Co. Florida on 01/05/2017. This was 6 months after the completion of the system install and just after we obtained counsel for our bankruptcy. They were included in our filing and discharge. We have and had not received any notice of this UCC action from Aqua Finance or their 3rd party biller Quantum 3 Group, LLC. Can they legally do this and are we obligated to pay this to close on our home sale? ...Read More

We are a Florida Subcontractor. We are due a retainage payment from a General Contractor. General Contractors do not pay retainage until 1 year after completion of project. How do we file a lien on a Retainage amount if liens can only be filed 90 days after last day on job?? Please advise. Thank You....Read More

Our office did a job for a 72 unit condo association in FL. We have a contract with the association to cover the equipment that we placed. NO construction/repair work was done. We only placed drying equipment. Would we need to place a lien on each individual unit or would we place it on the association as a whole? Will not having a contract with individual unit owners be an issue? Every unit had equipment in it, but for varying lengths of time. Our billing is to the association as a whole. ...Read More
