Hello, my wife and I hired a contractor in November of 2020 to rebuild our deck. We put half down on the agreed project. In December of 2020 the contractor suggested we build a top deck as well, we decided to go with his suggestion and paid a down payment for the top deck. I want to file a successful and valid lien, but Im unsure if I need to send notice of intent to the Owner Designee /New home buyers. Level Set sent the Notice of Intent to the previouse home owners & the General Contracter only, but since the Notice of Intent was sent, the owners sold the home to the General Contractor and the General Contractor sold it to the new home owners on March 18 2021. i paid levelset to file and record the lien , but none of the other parties complied, nor attempted to pay me, thus they having notice of intent, they sold the property, and I dont know if they let the new home buyere know that a lien may be filed. So do I have to give another notice of intent to the new home buyer prior to filing the lien although I sent notice to the previouse owners before selling as well as the General Contractor? I tried to find out who the prospect buyers were, address, & contact. The county did not have records because there wasnt any transfers in title yet, and the notice of intent went to previouse owners, and general contractor, so can I file the lien now and file the associated documents with the affidavit of return service as that alone being sufficient for a valid process and lien or do have to file a new notice of intent to new home buyer before filing the lien? Im in the time period of the 4 months where I have to file because the last day of work on the job was 3/5/21...Read More

I performed work on a new home built and the last day was March 5th 2021. Level Set sent notice of intent out to the General Contractor's who refused to pay me and the registered owners at the time, but since they've received notice of intent,they quickly transferred title to the new buyers on March 18th. At the time the notice was sent out, I tried to find out by calling the county who the new owners were, but nothing was officially recorded yet of any transfer of title. I wanted to provide the new home owner notice as well. My question is should the previous owners have let the new home owner know about the notice of intent to lien, or should they have been required to resolve the issue before closing, Also should I serve notice of intent to the new owners now that they're name's are recorded prior to filing the actual lien, or can I just file the lien with the notarized affidavit of service and return verifying that the previous owners and general contractor whom refused to pay me, bought the lot,built the home and then sold it to the new owners on 3/18/21? I want to have a valid process thus don't want to be disqualified but successful! The problem is that I last furnished labor and materials on the job 3/5/21 and it's almost the 4 months timebar? ...Read More
