I'm a digital markteting contractor who was hired by a sporting and events facility to broadcast live games and improve online traffic. I rigged up a 100 yd. cable that was anchored into the concrete wall to run a trolly cam also known as a condor cam. My agreement was to receive a base salary plus 10% of new revenue growth. All three of the building's leadership and management team were on the call when that agreement was made. I took the job on speculation knowing that they hadn't had good marketing advise in the past and I was confident in my abilities to double traffic. Traffic improved 129% and now they don't want to pay me the 10%. Can I file a mechanics lean just for the tension cable or can I include the whole amount?...Read More

HI, We have a client that is not wanting to pay our company the final payment owed for a construction project. We have filed the lien and notified the customer through Levelset and have been told the next step is to file a notice of action with the courts, is this correct and how do we go about it? Also what costs can be recovered? Can the past travel to and from the clients house to collect be included as they are a fair distance away and they didn't pay as promised? We gave discounts in good faith that at the end of the job our company would be paid in full, with the client not wanting to pay does that cause contract issues where the discounts can be recovered? Also interest on company cards for the materials owed on that are collecting fees? I guess we need to know what is recoverable as we're trying to be fair but have to be fair to ourselves as well. We did a project in 2020 for a client and it ended successfully and without issue. In 2021 he had a pipe freeze and burst in his kitchen. He was out of the country and we had below zero temps and he hadn’t shut his water off. We turned in an insurance claim and they covered it. He called us back to make the repairs and now he is not paying us. There was no formal contract as we didn’t know what we were doing until we arrived on the job site. He supplied most material. Have text messages asking us to repair for him but when it came time to be paid he said he paid us enough with he first job in 2020 that we should have money left over to cover it. He knows we didn’t because we did a recap for him previously. When we sent him the breakdown of 2020 job w invoices, showing we went over budget by $24.00 he said he would have his accountant review but it’s tax season so it’ll take awhile. We are going on 10 weeks since work completed. When we said we’d need to be paid or we’ll have to start the lien process he said it was our fault the flood happened and that he would sue us and we’d lose. He owes us $8900. The previous renovation was $250,000. He knows he owes us money because he sent our designer an email saying he needed receipts from her so he could get us paid. The $250,000 job was fully permitted, licensed subs in all areas and passed all inspections. He says now it’s terrible work but prior to this we never heard one bad thing about our work. We did a job for a client who then refused to pay their final bill. Thru Levelset, we sent a Notice of Intent to File a Lien and then filed a Lien. My window to File Lawsuit to Enforce Lien or Cancel Lien expired a month ago. I misunderstood and thought that I had 6 months from filing the lien. Do I have any options at this point? Can I at least send her to collections? How do advise me to proceed. Thank you for your help....Read More

I fired a contractor who did not complete the full scope of my basement renovation in the time allowed (originally quoted 1 week, project dragged for 5 months). I have paid him in full for every line item that is 100% complete, and even paid him a discretionary amount for incomplete line items proportional to their completion. I expect a lien to be leveled on my property regardless for an amount <$1,000. I have excellent project documentation, what are the consequences in Colorado for the accuser if the lien is proven to be fraudulent and / or exaggerated? Last April a friend came to my house and asked me if he could stay at my house for 2 months and do work on my house in lieu of rent. I agreed and around June he got a large puppy. He was living in my basement apartment. The puppy started digging everywhere on my property and his owner never cleaned up after him. I allowed him to stay longer as he kept starting new projects. In November, I politely asked him to clean up his dogs mess in my yard and he got mean and said, “I won’t be here for Thanksgiving. I certainly don’t give thanks for you”. At that, I told him to leave my property and I would help him pack. He said I have rights and that’s how the mess started. He said to me, I’m staying until the end. To have someone in your home who you dispise made my life hell. He refused to leave, kept using my utilities until I finally hired an attorney to get him out. He was given a notice to quit. At lease on 7 separate occasions I called the sheriff on him as he was pounding on the stairs late at night and trashed the downstairs. He would throw trash,cans, etc on the carpet. On Thanksgiving he handed me a notice of intent to lien. And filed that lien against my house. There was never a written agreement and finally on Dec.31st 2021, he left after 3 sheriffs had talks with him. I hired an attorney to only use his letterhead to send him a letter asking him to remove the lien. He sent a long letter and attached an agreement for me to sign saying I would pay him $4,200 by March 14th. This lien is spurious and I can’t understand how doing a favor for a friend has made it impossible to sell or refinance my house. This man wants to take my house of 21 year away from me. I’m 73 and on a fixed income. I am a glass artist and work to supplement my income in my home studio. I applied for a reverse mortgage and it was ready to close in December and got a call that the reverse mortgage couldn’t close until the lien was paid. The person who filed the lien has done this before. I had no idea the kind of person I thought was a friend. Then yesterday he replied to the letter with the attorney’s name on it and threatened me and my house. I do not have the funds to hire an attorney. I already charged about $2000+ on credit cards and I’m maxed out. This lien should never have been filed. I’ve been to adult protective services, and other places to try to get help. The attorney who let me send the letter on his letterhead wants $5000 as a retainer. I can’t do that. I was going to take him to small claims court to ask for rent of $1300 for 8 months. Since he filed the lien for work and materials with nothing signed, I feel I have the right to collect rent for the 8 months he stayed here. My utilities tripled while he stayed and he used my electricity to charge his Tesla....Read More

I’m a homeowner who allowed a friend to live in my basement apartment. The verbal agreement was that he could live in my basement apartment and work on my house in lieu of rent. He was to stay for 2 months but kept doing work so I allowed him to stay longer. While living in the apartment, he got a puppy and the problems started. The dog did damage to my property and his owner refused to clean up after the dog. Eight months later I asked this person to move out. He refused, and kept staying and using all my amenities. He put a lien on my house for about $5,000 for doing work. There was never a written agreement. I had the sheriff’s out to my house as the person was intimidating to say the least. On a current construction project, the title company is requiring conditionals and unconditional lien waivers for "lienable services" for vendors such as architects, engineers, surveyors, design professionals, and construction managers. These vendors do not provide furnished materials and do not contribute to any physical construction of the property. I thought lien waivers were only required for sub contractors who do physical work on the property. Do these service providers have the right to file a lien and what type of lien would they file if any?...Read More

I contracted with my client ( Dan ) to consult with him to build his house. He wanted to be the GC to save money and I was to be his coach ( Consultant ) I own and operate MNJ Consulting by Design. ) I ended up going way beyond the ordinary scope of consulting to actually preforming 95% of the GC duties. Dan is not only contracted with me but also with all of the subcontractors who built his house. He owes them money as well. No harm in that except that he owes me invoices for labor and fee dated back to Oct 10th 2021. To the tune of around 10,000 dollars. He ripped up my last past due invoice in November. I want to get paid. His house is almost complete. No CO yet. He just needs his final plumb, electrical and building final inspections. Dan is in his 70's and is a very angry man and he thinks he is being ripped off by all of the subs and also by me. He is quite possibly Bi Polar. I put together his budget and he is 90 + K under budget and ahead of schedule. He is funding his construction project out of his pocket. Last Material shipped to site = 10/6/21; Lien filed on 12/3/21 in Colorado. Lien includes (3) parties. Statutes of limitation has expired. It has been determined that (1) entity should be removed from the lien. Can we amend the lien to remove that entity and still leave the remaining (2)? or would we need to refile the lien? or would we even be unable to file a new lien because the statutes expired?...Read More
