I'm a property owner who hired a GC to build a house on my property. when the GC exceeded the total estimate for the house by $80K, I told him that I was terminating the current construction contract and offered him a new one. He refused this offer and refused to sign the Lien Release that I gave him, and packed his tools and left the job site. He sent me a last invoice for work done. There are 4 subs who are owed money on that invoice. Since I do not now trust the GC, I intend to pay the subs myself. I need a Lien Release that will give me peace of mind that these subs will not file a lien against me in the future. I have paid for the cost of construction myself there is no loan. I have done a Job in December 22 was the last days we were on the job site. now we have gotten multiple payment both checks and by square the app. Now the the guy that hire us let us go for now showing on Christmas Day. but a month later he disputed on of the payments he had made. We started work on a project yesterday and completed about $3000 worth of work when we had only received a $1500 retainer deposit. Our contract terms require a larger deposit on day work starts and we made 3 attempts yesterday to collect the deposit, all of which were ignored. Can we release the client from the contract and move on? I am not trying to collect anything, we are just too busy to track down money and since this is the first payment, it seems like a sin of things to come. I know the answer seems obvious, but I want to make sure I am protecting myself legally and that we can email a release from the contract and go on to our next project without repercissions. I may have been scammed. I replaced a roof on a property for a person claiming to be the owner. Although, in my gut I started feeling this guy was not on the up and up. He asked me to initiate payments via credit card which I did not do previously. Once the job was done he asked me to add $4,700 to my invoice and once I got payment, he wanted me to send his broker the extra money to finalize fees from the closing of the house he just purchased and I reroofed. Once I did as he requested, he asked me to do more money on his credit card. When I refused him, he got very belligerent and cancelled his credit card payment. I looked on the county website - it is not his name on the property records, it is under an LLC. I'm at a loss on what I can do to try to get my money back from this guy. If he really is not the owner of the property, will a lien on the property benefit me at all? I believe I have his address which I got when he gave me his credit card information. ...Read More

I am worried a contractor may try and place a mechanics lien on my converted school bus. There was never a written or signed bid/contract and they are saying I owe them the final payment of $1500 even though I do not believe the agreed upon work was completed. On January 17, 2022 we had a meeting and I sent a text outlining what I believed was agreed upon. That was ignored until January 27, 2022 and was subsequently verbally amended and that work also hasn’t been completed to what was agreed upon or expected. We were hired to complete a radon project at a private residence where a deposit was collected and labor, parts and materials were scheduled and purchased. Upon showing up to the property, we discovered the information we were given multiple times by the owner was grossly incorrect. As a result, we were unable to complete the the project to the original scope and plan that day and a further assessment and further expert advice was given to the owner at the property. The owner and our company agreed to expand the project to meet the owner's requirements and a follow up quote and proposal was provided. Our technician was on site for 1.5 hrs and over an hour of travel time was required to get to and from the site. The home owner then decided to hire a non-radon certified professional (a plumber) and decided to not use our services going forward. We are now requesting that they pay the now overdue remaining balance for the original project we were hired to do which they have refused to pay. Are terms our clear that the the remaining invoice is to be paid on the day of the installation and we only agreed not to collect on on the day given we would expand the project. I am now going to retroactively apply late fees, accrued interest, etc. per our terms but I need to know if I add this to the final amount we will be seeking in a lien? I also need to know if I apply the fees to file such a lien if needed and service fees from Levelset in the lien amount? Or do I add these later if a lien is required to filed?
