Can a contractor file a lien on my house if NO REPAIRS or work has actually been completed? I signed the contract almost 2 months ago. There is no price on the contract, it states I am required to pay a $2000 deductible and that's it. The contract also states that payment is required upon COMPLETION of each trade. The only thing that has been done is mold/asbestos testing, which I've already paid. I have given the contractor $4500.00 already and no work has been done on my house or even scheduled. No estimates have been sent to my insurance adjuster either.I am trying to use a different contractor because nothing is being done on my house but the contractor wants more money....Read More

Hello, I filed an intent to Lien on my 'NOHO' project. I have a contract to build the pool from start to finish. From not only 24Hour Fitness who filed bankruptcy and I lost money, but now from the new developer. Without any notice, their project manager hired a different company at a lower price to plaster the pool that I built. They breached their contract with my company that included an amount of $40,000 (+) for me to plaster and complete the pool. They have not paid me the negotiated contracted price for plastering the pool. They never formally canceled the contract and have likely completed the pool using my plans, which they did not pay for. I have filed an intent to lien through Levelset. I have not heard anything back from Levelset or the client. Please I need someone to tell me what I need to do next. Our company (GC) requires that an unconditional lien waiver be signed at the time the check is picked up. However, we have one sub who is refusing to sign the lien waiver until the check clears her account. I tried to explain that's not how it works, and that the signed lien waiver means check is in hand, but we're currently at a standstill. We don't offer Conditional Waivers, and she is refusing to sign at the time of check pick-up, because she is claiming that it is "the law" that the check first clears her account. i have dispute with the general contractor on work he performed on my home. I have a signed contract with the GC that has penalties for not doing work on time which has essentially reduced what I owe the GC to zero.. He owes 2 subcontractors $5k each for a total of $10k and is claiming if I don't pay him, the subcontractors will come after me directly for payment.. can the GC's subs come after me directly if the GC does not pay them?...Read More

Many times we are one of the first contractors on site. We typically finish our work within a few months. These projects that we are working on take sometimes 2-3 years before they are complete. Per Colorado law we have to file a lien within 120 days of the last day we are on site, thus we typically send an email stating our intentions to start the lien process at 90 days, file a notice of intent at day 100 and file the lien around day 110 if we still have not received payment - for all payments, not including retention. The problem is that the GC's/Owners are pushing back and telling us the owner has not released retention thus they cannot release retention. So for a project that is 2 years long and we are done with our scope within the first 6 months, by the time the project gets to the end, and the owner starts releasing retainage, we are well past the 120 day mark and seemingly don't have leverage because a lien would be null. The best we have seen done up to this point is to have our retention held reduced by half....Read More
