I did a lien on some property I got it all filed with Denver Clerk recorders they title people called to have me verify my signature. I have done every thing this job started may 2020 we did part of the job by June 2020 the owner just got home from hospital did work here and there oct 2020 went back to complete the job and the owner had died so we did some more work the wife asked if we could come back in December and finish the job and she will take care of us so December 21 2020 we completed the job and the wife said I would have to go to the HEWITT ESTATE TO GET PAID SO I GOT AHOKD OF TGE ADMENASTRATER THAT WAS HANDLING THE HEWITT ESTATE AND TRYED TO GET PAID BY HER SHE WAS NOT PAYING IT EITHER SO I DID A INTENT TO LIEN IN FEB I WAIT 2 months NO ANSWER SO I DID THE MECHANIC LEAN I SENT A NITHER INTENT TO LIEN NO ANSWER SO APRIL I FILED THE LIEN WITH DENVER COUNTY CLERKS RECORDERS I GET A CALL FROM THE TITEL PEOPLE TI VERIFY MY SIGNATURE I SAID NO PROBLEM SHE SAID SHE WOULD GET BACK TO ME TO VERIFY MY SIGNATURE I SAID THAT WAS FINE SHE SAID THEY ARE SALING THE HOUSE ON THE SEPT 30 SO AFTER MY SIGNATURE WAS VERIFIED THEY WOUKD PAYME I SAID GREAT. WELL TWO DAYS AFTER THAT TGE TITEL LADY CALLED ME SND SAID THAT THE LIEN IS NO GOOD AND THEY HAVE REMOVED THE LIEN AND THEY WHERENT PAYING ME BECAUSE THE PROBATE LAWYER THAT IS HANDLING THE ESTATE TOLD THE TITEL PEOPLE THAT DONT WORRY ABOUT THAT LIEN IT IS NO GOOD SO I GO BACK TO THE DENVER CLERK RECORDERS TO SEE IF THE LIEN HAS BEEN REMOVED IT WAS STILL ON FILE AND THE CLERK TOLD ME I HAVE ONE MONTH THAT I NEED TO GET A JUDGEMENT THROUGH THE COURTS TO MAKE SURE I GET MY MONEY I DONT KNOW HOW ABOUTS TO GO TO GET THAT JUDGEMENT AND THEY ARE SALING THE HOME WITH MY LIEN ON THE PROPERTY BECAUSE THE TITEL PEOPLE SAID THE PROBATE LAWYER SAID TO GO A HEAD WITH TGE SALE AND DONT WORRY ABOUT THAT LIEN SO TGAT IS WHAT THEY ARE DOING WHAT CAN I DO TO GET MT MONEY THSNK YOU ...Read More

I am a project manager. I was hired to find a gc, all subs and all supplies for basement remodeling. Client decided to not pay anything above what I paid out and we lost 20,000.00 that we were really planning on when we got nixed from the job. On a deadline of a baby due date we busted our tails to complete on time. The drywaller that was hired through another gc on the project (framer) , was paid in full and decided to go to the homeowner and say he was not. He ransomed the job for almost a month. So to be done in time,, we hired our team to go in a knock it out with us.. We bought all supplies and half way through he shows up. He talked bad about all of our work (that was not complete!!!) and the homeowner listened to him and not me. Not sure why. He told him that it all needed to come down, drywall and all. (He hung the drywall btw) HO heard he could finish faster and not only paid him AGAIN, but paid him 5000.00 to tear out everything we did. It only needed to be sanded and thats all he did.. He never removed anything! HO said he'd take care of it, and we could go. Mind blown. I think my only option is to file a lein to be reimbersed. Is that correct? I put in 3 months of work on this job. We did everything. We hired electrician, plumber, hvac, bathroom, carpet (which I canceled) framer, insulation and GC. I applied for and obtained permits, and met inspectors, with GC and was there for every thing that needed to be done. My team was there, my company was very much responsible for the successfully completed jobs. We need to pay the people who werent paid in the process. We hired a general contractor to remodel do 2 bathrooms. After he said he was done we noticed issues with his work. He didn’t do what he was hired to do. The wall was not completely done the bathroom door was not hung properly and the shower didn’t drain properly. We brought these to his attention and he came out a couple more times and didn’t fix any of the issues he refused the redo the shower floor and only did half of the wall and didn’t touch the door. He once again said he was done with the project There is more to the issues regarding tearing out the bathroom months before he starting the construction etc We had to hire someone else to fix his mistakes and now he is putting a lien on the house for the final payment that we didn’t pay since he didn’t do the work properly as promised ...Read More

So we paid are under a contract with a contractor, the job is not done to completion at all and he will not answer our texts, calls or emails. Our contract was written where we pay for half the job and the other half at completion which we are still waiting on. We received a mechanics lien on our door today because the contract has apparently not paid the subcontractors for work. It is not legal because it has not been notarized. We cannot get ahold of the contractor to get any of the punch list completed nor has anyone been out to our home in months. Are we liable for anything with the mechanics lien if the contractor hasn't paid them? Liens were filed against our house because the builder did not pay subcontractors…. However the builder was paid in full!! We would like to sell/transfer ownership of the house. Is this possible with existing liens? The builder is currently charged but has rejected the legal offer made to him and is now awaiting trial from what we understand. A contractor and I agreed to certain work at my house for $900, which I paid him in three progress payments of $300 each. During the original project I asked if he would do some additional things, which he did, and I offered to pay more but he never asked for any additional money. Before the original work was finished, though, he walked off the job and demanded more money, leaving a huge mess and the incomplete project. Now he’s threatening to file a lien, but we never had a written contract and he never sent me any invoices for the original work or the additional work. We sent an NOI and filed a Lien on a job in Colorado, without Prime Contractor info. We now have that information and are still well within our lien rights period. We have already previously asked the legal team what to do and they said the correct process is to release the lien and refile an "amended lien" as the original lien statement. We have released the lien and are about to order the NOI and then wait the 10 days to file the amended lien. My question is, can I order an NOI normally in levelset, or do I need to send an "amended" NOI the same as I have to send an amended lien?...Read More
