I have several invoices outstanding for project management I performed for a general contractor across multiples sites, so I'm working on filing a lien for the value of the time I spent working on each project against each corresponding property. Can I file two lines on one property? One would be for project management work, the other would be for construction (handyman) labor I performed on the site under a separate invoice. When I send my NOI, can I send all of them in one envelope to the GC? Do I have to send the owners NOI to their residential address, or can I send it to their project address if it has a mailbox?...Read More

I work for myself. I was hired by my buddies boss to rebuild a motor in a 300 Chrysler. This motor was already taken apart and left on the ground. I'm the 2nd person to pick up after the 1st guy left. We were both unsure if it would start after o rebuilt it from this state. After 2 months of rebuilding this motor, it would not start. He called me last week and said he was taking it to a dealership. He owes for my labor over these 2 months. Do I lean his home or the vehicle. His intentions were/are to sell it after it starts. If it ever does. ...Read More

I have started the lien paperwork on a renovation myself (Primary Contractor) and my Sub-Contractor were not paid on. Here are the details and question. We have a previous co-owner (Ryan Nazario) and who approved the work, a brand new sole owner (Tom Campbell) who is refusing to pay, I am the primary contractor (project manager) hired by Ryan and a sub-contractor (Jeremy Hawkins) for the construction hired by myself. Both Jeremy and my contracts stated we would be paid at the sale of the property. Along with managing the project/reno, I also provided all material for the reno (out of my own pocket). FYI previously Ryan & Tom had a private note, payment to Tom became an issue and Tom filed to obtain title in which he was given. Can Jeremy and I (both contractors) file ONE lien? Or do we need to file two separate liens? Thanks, Beth McClave 719-582-3402...Read More

We are getting ready to file lien(s) but this is a strange situation. I was first hired and contracted as a project manager to manage a commercial and residential renovation to then sell. I hired and contracted a contractor to do most of the work (construction, electrical, tile etc). In addition to my project manager role, I also did some of the painting and landscaping to reduce cost. All of my credit cards were used to fund the materials and myself and my contractor's contract stated we would be paid at the sale of the property. Midway through the reno, I was added to the property as a co-owner. Toward the end of the project/renovation, the investor and the original owner had a disagreement regarding the note (I was not on or added to just the title). The investor ended up taking the property and has said and threatened that he will NOT pay anyone or reimburse anyone for our labor, time, job or contract(s). My first question is, because I was a contractor first with a contract but then became a co-owner, can I file a lien. When I was added as a co-owner my contract with the original owner stayed in place and I continued to provide labor. Nothing changed there. My contractor is filing a lien against the investor/new owner and I was told along with him, I can file my own separately too.....is this true? My second question is, if I can file a lien, would we both be considered GC's? Or is he the GC and I'm a sub? Or visa versa? This is a very complicated situation regarding ownership and contractors and just trying to get paid what I put in and are owned per contracts. Thanks in advance for your help. I am in Colorado. I contracted with Moxie Solar in IA for a system to be installed. Moxie solar used Solar Supply of Colorado to perform the install and electrical work. I made two of three payments to Moxie Solar ($20,000) and Moxie Solar is now out of business. My install is not complete or operational. Solar Supply of Colorado wants to complete my install for the remaining $10,000; however, I am still contracted with Moxie Solar, and I have no contract with Solar Supply of Colorado. I don't know what, if anything, was paid to Solar Supply of Colorado by Moxie Solar for the work that was done to my house. I don't know if there was an actual contract between Moxie Solar and Solar Supply of Colorado. Can Solar Supply of Colorado put a lien on my property? There was water problem on a Rental that I manage for my son. Serve Pro was called to clean up the water. They pulled out the water and put up fans, and called to say the floors would need to be pulled up to dry under them, and they could bill the insurance for an estimated charge of $3,921.86. I told her, that I had to check with my son, and inquired what the charges were for what was already completed. She stated the charges so far were $740. I spoke with my son, who felt he wanted a second opinion to decide if that extent of work was truely necessary before deciding to file an insurance claim. I called her immediately and stated that he did not want to go forward and they should remove the fans. The next day, they came to remove the fans, and service person called to say I needed to confirm that I understood there was moisture under the floor. I confirmed on the telephone that I understood that, and indeed wanted them to remove the fans. I got a bill for the full amount of $3, 921.86 via email. I called to remind the person I spoke to initially, who had identified as a part owner, that we had stopped the work, and she had said it would be $740 . She looked at her notes and said she saw the $740, but did not write what it was for. I told her to please send me a bill for the $740 and would pay it immediately. Again I sent an invoice for the full $3,921.86. Again I called and requested she call me, and advised the secretary that I would be happy to pay the correct amount of $740 to please speak with the first person to confirm and send the correct invoice for immediate payment. I then received a copy of a Mechanics Lien for the full $3,921.86 that had been filed in Arapahoe County where the work, ()the $740 worth or work), not the almost $4,000 worth of work had been done. How can I contest this? It is an eronious charge. Not only was the work not done, there was never a contract or a verbal agreement for anything more than the initial service that was $740.00....Read More
