I'm an electrical contractor. We design and build energy projects for home owners like pv, storage, generators. Also do service and other elec work. Supply chain struggles dictate that we have to purchase from many vendors now. New ones demand payment in full to ship. Huge strain on our cash. Have considered the usual deposit at signing of lesser of 10% or 1 k and then billing for the equipment we have to special order, minimally 4 business days after contract signing. ...Read More

I have a client that are not willing to pay us unless we reciprocally exchange check for unconditional release on final payment. We are located in California and I know that a Unconditional release will leave us without any rights if the check doesn't clear the bank. We filed a preliminary notice in May of 2021, and then filed our lien in April of 2022. We were notified by the property owner that the NOC was filed in July of 2021 so we no longer had lien rights. We were never sent a copy of the NOC , or notified that one was filed. Do we still have lien rights since we weren't notified? ...Read More

Hello, Is it possible to file a mechanics lien for unbilled change orders and retention? We have outstanding changes that haven't been approved yet so we are unable to bill for them. And typically we're not able to bill retention until the project has been completed. According to our project manager, all the changes are legitimate, the work has been completed. Our lien rights are going to expire soon so what would we need to do in this situation? Can we still file a lien for everything outstanding?...Read More

Private funded project involving roadway improvements for a lot split. The city comes in and request additional work to the city water supply system. The additional work is under a separate contract with the city and is almost $50,000 . Additional work does not improve the property involved. It is performed by the same subcontractor but without any knowledge to the owner of the property in question. Can the Sub file a mechanics lien for the city requested extras without any preliminary notice being sent regarding the extra / separate contract work?...Read More

Im a subcontractor I gave a proposal to a general contractor, they liked our proposal, signed a contract and I sent out a preliminary notice. I've invested time and money into the project, we started working on the project in November 2021(shoring and bracing), the owners made major changes after they had already signed the contract and now they didn't accept the change order price and they decided to give the job to someone else.
