We are a subcontractor providing custom acrylic panels for a pool in California. Our contract clearly states, payment in full prior to ship and the client is now saying they won't pay until it's delivered. We are complete with the production side of it but are holding onto the acrylic for now. Is filing the preliminary notice the best way to go? I don't know if we have met the following. Not sure what is meant by "claimant ceases to provide work." The mechanics lien deadline for parties hired by someone other than the owner is set out by § 8414 of the California Civil Code: “(a) After the claimant ceases to provide work. (b) Before the earlier of the following times: (1) Ninety days after completion of the work of improvement. (2) Thirty days after the owner records a notice of completion or cessation.”...Read More

The contractor for our solar project filed 2 liens on our home in January of 2022. He was paid in full for the contract amount in October of 2021 by our finance company without our approval. We had a change order for 4500.00 and I am assuming that is what the lien is for. We were given an intent to lien letter but that is all. We never received an actual lien and I didnt worry about it because he was paid. None of the project is 100% complete. We rescheduled several appointments with the utility company for switching the power to new panel. He says we are in breach of contract for preventing him from finishing. The panel he installed was a 100 amp and the change order upgrades it to a 225 amp panel. He continually lies and I need to know what I can do about it. He is trying to make us sell our home to pay him. We have already filed a complaint with the contractors state license board and now we received a law suit in the mail. This guy is off the hook. Can he do this legally?? Take our home??...Read More

Hi I'm a subcontractor, i received a demand for payment notice of claim for defense and indemnity. Its stating here that we did all the electrical work which we didn't. We never went on contract or sign any contract with the contractor, we did just minor work for one day only and got paid cash. We gave him a quote to be in contract with him for the rest of the job, but it never happened he must've no like the price. I pulled a permit from the County of Contra Costa to remodel a kitchen /bathroom/flooring and Windows. I find out the owner is offering my under 21 year old employee marijuana. The Owner Gary is a drunk and don't know from one minute to the next if he is going to go off and hell at us and call us out. He hasn't paid us and is threatening us, and telling us he will not pay. The contractor did some terrible work and I told him to fix which he didn't. I therefore didn't pay him the other 50%. He threatened me and my wife therefore I called the police and filed a report. Now he sent (what looks like) two fraudulent mechanics liens that I cannot verify since there is a 4-6 week wait at the recorders office. I am a home owner. A job was done that was never completed, so have not paid. This was 2 and a half years ago. The house was my elderly mother's home at the time the job was started in February 2020, she passed away 6 months later. I inherited her home June 2020. I am selling now and currently in escrow, about to close yesterday and get a call from title company that a lien was put on my house two days prior. All of a sudden, out of the blue?? We are providing fixtures to a retail location under construction. Our client is the store chain. We provided a first round of materials to the job in early April. Hello, We are a window supplier and installer. One of our vendors has placed a pre-lien on our customer's home for windows that we ordered. The windows were never taken to the site and are still at our warehouse where the vendor delivered them.
