Hi, We are a small construction company mainly dealing with residential sector. Due to an understanding reason we hire subcontractors for variety of works. After last year's analysis we have come to understanding that most, if not all of our delays were caused by the subcontractors. Subcontractors are not always on time to do their work which leads the project to fall behind, increasing extra cost and clients dissatisfaction and therefore loss in profit. I would like to ask if there waiver template we can use which would oblige the subcontractor to be on agreed date and if they are not then they simply liable for the penalty or certain fee occurred due to the delay?...Read More

Hi, I am a Plumbing Subcontractor in San Jose, CA. We have a public project with a local municipality here and working through a GC. Our contract with the GC is based on T & M. We have worked almost 100% and gotten paid about 50%. We did not file a preliminary notice on this project but filed a stop notice just recently. We think the way to go is to file a bond claim at this time since the GC is not paying us. Our T & M Billings is about $1.8M at the moment. Can you help us out, please? I work at a rock quarry running at 627 push pull scraper. This was a 1997 With two rebuilt engines put in previously by the company’s mechanics at lay down yard prior to my use. This machine kept having issues . The day of the accident I kept loosing the back engine meaning it would shut down, causing me to have to pull away from my partner stop get out start it back up, call my boss and mechanic trying to get a hold of them to let them know the issue. I have text messages from this day and days prior Warning buzzer was going off and I had I’ll kinds of lights on dashboard . I Should have shut the machine down and waited to keep going until it was looked at. This was the job of my dreams and I didn’t wanna lose it scrapers never stop on a job you keep moving dirt! Back engine kept dying, this thing at problems from the start! The accident was 8/9/2018 After calling at least 40 lawyers not knowing how to do any of this, I finally settled with the first one that said they take the case. Not knowing they’re young and just trying to make a name for themselves they haven’t communicated with me on how this whole thing works! I’m at a loss, but I’m not a quitter! I need to get rid of them fast I’m running out of time nobody seems to want to take my case because it’s one of the biggest construction companies in California . My accident caused a large investigation with MSHA at the qaury Send company to get three heavy citations for gross negligence. A K Order around the scraper securing the machine on the cliff for 3 weeks so they could have Caterpillar come do a investigation, which I thought very odd why would they have caterpillar come out and do a investigation on them selves So they changed it having a Holt come out a 3rd party so they say. And because of all of this the company got cited for three heavy citations from MSHA. Who made sure I knew that he was good Friends with this company for 20 + years. I have reason to believe that caterpillar is where the main problem is. The engines the day of the accident both engines completely shut down Freewheeling me off the cliff with seconds to try to drop my can my blade scraped over a boulder as big my bowl pulling me over the embankment rolling three times landing upside down on a cliff as wide as my machine .I believe that bolder and seatbelt saved my life along with having a full load. My machine ROPS bent completely as the cab crushed around me windows blown out the sounds metal twisting and bending. Nobody can believe I got out of this twisted metal Alive. I couldn’t be more lucky!! I was take in an ambulance, the dr ex rated my knee sowed up my arm and sent me out the door. I felt numb and very upset!! I had to call a Union rep to pick me up from hospital 5 hours after the accident, And I have no idea why I was in the hospital the company had not called to let them now I went to drs. Told them I didn’t know how I was feeling my body was very sore , I was confused, frantic, and wanted answers!! Approx 5 to six weeks later my neck and lower back just ached, I told there dr.s and they said I couldn’t just say that weeks after accident and wouldn’t help me, but did send me to Phycyatrist to be put on pills. From for- seen death syndrome. (Severe PTSD) Yes y back still hurts and when I turn my head left a shooting pain Goes over the top of my head and almost blinds me. What do I do somebody has to help me I know there’s a lawyer out there that will take on this challenge!! Please HELP!!...Read More

Hi - I am a residential homeowner in California who has been in a dispute with a contractor who did some work on my property and have been served a mechanics lien that was sent by Construction Notice Services, Inc. The link appears to have been recorded on my property as per the letters. The amount of the lien is roughly $1,000, which is what the contractor believes they are still owed. I believe this lien to be invalid both because the terms of the contract have not been fulfilled by the contractor, and the deadlines for filing the lien has passed (the job was substantially completed 9 months ago. Questions below. Thanks in advance for any insights. Questions: 1) How can I check to see if a lien has actually been recorded properly? 2) Is it worth it for the contractor to enforce the lien given the monetary value ($1,000) of the dispute in question? How much does it cost the contractor to actually try to enforce the lien? 3) They also put an interest charge from when they believed the payment to be due of just under 2%. Are they within their rights to do so? 4) Assuming the lien is invalid, what are the next steps I should take to try to remove the lien from my property, and how long does this process take? 5) Are there any repercussions for the contractor or the company that they used (construction notice services, inc) for filing an invalid lien that doesn't meet the required timelines? ...Read More

I have an issue with an unlicensed subcontractor who was hired by a general contractor to perform painting services. The painter made an awful mess requring the general to pay a majority of the contract price to mitigate the sub's damage to the homeowner's interior. The sub wants the full amount and seeks to enforce a mechanics lien against the homeowner to recoup the amount owed despite the fact general contractor had to spend most of the contract price to fix the sub's horrible work. The general did not find out the sub was unlicensed until after the work was finished. 1. Can an unlicensed sub in CA enforce a mechanics lien? 2. we are a concrete ready mix company and the contractor forgot to cancel the order. The truck was loaded and was out for delivery before he remembered to cancel the job, so the concrete got dumped (we always try to send to another job whenever possible, however this was not the case.
