We have done business with Lennar Homes on a city project andthey h ave not paid one invoice in 8 months. We need help determining whether we file a Miller Act Bond Claim or a Stop Payment notice and if so what kind of stop notice.
They have been non responsive and we want to get their attention the best way possible.
CaliforniaI'm a contractor who remodeled the house and customer didn't pay.
CaliforniaI made a mathematical error on my bid. Each line item is priced correctly but the spreadsheet did not add up the totals correctly.
I signed a contract and attached the bid as an addendum, so thankfully, anyone can add up the numbers and see the math is simply wrong. Each item is correct, but the total is not.
However , now the cost is $25,000 more than the customer had planned.
Am I liable to pay the difference or is this a material mistake that is obvious to all parties.

CaliforniaI just receive a notice of intent to lien from a contractor who we decided not to use on our project. claiming he time is worth $2000 and he never sent a complete bid and we never signed anything.
CaliforniaSomeone is filing against my contractor's bond from over 3 years ago and I never had a contract or payment from this party. I never did any work through them, but a previous owner. They didn't even purchase this property until 5/1/17. Job was signed off by city 1/16/16 according to all building codes and permits. I am thinking they have no claim and are being frivolous. CaliforniaBuilt ADU. Payment schedule was current. Owner's asked for additional work, Video Cameras, Electrical, Plumbing on their existing residence. Last payment comes due and the owner does not want to pay because they say we didn't give them change orders. We have e-mails and text messages confirming their needs. End of job, five (5) item punch list: install towel bar etc in bathroom, touch of paint on two doors and paint 1" x 30" area above portion of back splash they changed out. Sent out 20-day notice. Owner's sent notice of Cessation within days. Confirm that I can immediately record a Mechanics's Lien.
Californiai won a large sum of money on a scratcher was told it would be 4-6 weeks then told 6-8 weeks then 8-10 weeks well today it has been 10 weeks and they said it was submitted july 2nd for check to be printed but have not been given a print date for check
CaliforniaWhen we are getting information for preliminaries, when it is asking for the lender - is it the lender in regards to that project only or the lender for the mortgage on the buildng?
CaliforniaWe need to revise our remaining payment schedule because of schedule changes to the remaining work. No change order to final project total. Do we need to update our contract to reflect these changes (much like we do on a change order)? Thanks!
California20 day notice was not sent on time is my lien valid
CaliforniaAfter growing a successful GC business from $0 to $15M over the last 5 years, me and my partner are now starting anew with our own company, Carbon Zero Buildings. We develop design and install multitrade energy and water upgrades like heat pumps, boilers solar, etc. Our customers are owners and operators of large multifamily properties. Our typical project size is $150,000, but ranges from $20,000 to $2M. We would like to start our business with a solid prime contract template that works for our business and our customers. And we will need the same for our subcontractor agreements, too. Can we get by with using standard templates like AIA or ConcensusDocs? Or LegalZoom or RocketLawyer? Or would we be better off hiring a lawyer to provide us with a custom template who understands the nuances of California law and/or multifamily real estate? We are on a start up budget but willing to make the investment if necessary. Any advice would be greatly appreciated.
CaliforniaWe are a general engineering constractor in California working for a general contractor on a project we started in 2021. At the time the project began there was no lender but we have been notified recently this has changed. I understand there are issues and concerns with updating or amending a notice after the initial 20- day period has expired but with both a significant changed in contract scope & total along with there is now a lender on the project is it advisable to send a new preliminary notice? And if yes, how would I go about doing this?
CaliforniaI stay too busy...I don't advertise anywhere, nowhere period. I haven't had a business card in at least 5 years probably longer. How do I get customers to give me a break and stop calling for 6 or 8 months while I get caught up? Can someone sue me for taking a leave of absence ?
