I am a cabinet maker owed approx. $50k from a residential project. The contractor has been stringing me along for several months and is now not returning my calls.
CaliforniaMy name is Reynaldo Johnson, I am the president of the Rio Viejo Water Well Community, my question is that one of the associated owners is delinquent in there water bill and the ownership is requesting to have a property lien place on there property for the delinquent payments of water usage.
CaliforniaI paid my contractor for a couple of progress payments and received a prelim lien from the supplier. The contractor has not paid either the sub or supplier.
Do I need unconditional waiver and release on progress payments from both the sub and supplier or just the supplier?
Also would I need to issue a conditional final payment release to just the supplier?
CaliforniaI hired a company to fix my stucco and paint my house and they told me that they had a crew of guys all in house to do the work. One guy shows up and I find out he does not work for them they approached him a couple days earlier and that he is not licensed
CaliforniaHi, I’m a GC worked on a major remodel in CA, my customer had some legal background and had a big problem with payment and had me do extra work and kinda push me to work in Pandemic. we finished the job other than touch ups and asked for the payments but he didn’t want to pay the balance and he made a claim to our insurance company first. Then, attorney from insurance company told him it’s just punch list items so it is not covered by them. After that he made a complain to CSLB license board with bunch of documents that he’s been collecting with long emails during the project. Cslb said they will open up an investigation so how should I respond to them? What’s best way to handle this type of situation? He still owes us many and makes us deal with the cslb .it would be great if you guys gives us some advice.

It would be helpful to me to know as we are creating our own in house budgeting department.

Californialuis angulo was not able to do the work correctly and timely so i had to hire someone else who was capable to finish the work .furthermore, he was drinking, and doing drug on the job and he was not able to do the job as timely promised by the due date. he got inept people including himself to try to do the work and was not able to do the work corrrectly.

CaliforniaWe have a customer that is hauling approximately 1,500 tons into our Landfill, estimating $ 102,000.00, I created a prelien with an estimate of $ 120,000.00, but they still keep on hauling more material into our site, so far they have a balance of $ 126,000.00.
I would like to know if we can prelien the job for a higher amount of what they estimated, please advise.

CaliforniaCommon mistake(s) by a contractor in the whole process of the progress payment claim. During interim payment claim, what's the common mistake made by a certain contractors that leads to claim failure.
CaliforniaWe are a sub sub contractor for a job. We filed a Stop Payment Notice delay claim in Oct 2020. Since then we have additional delay claim costs plus we have an additional claim regarding unfunded change orders. Do we file two new claims or is there a better method to handle? The public entity, direct contractor, surety, etc. are the same.
CaliforniaOn Feb 18 , 2021 I agree a contractor to replace my windows and replace some wood to my mobile home. Next day the crew were there and replace the bad wood without my permission. No call just show up . Cost $2500. I live in a mobile hone. Next day I told the contractor to hold the window for now they try many times to install the windows but I told them to wait because of my situation I’m taking care full time my 83 yrs old mom with dementia and asthma,and need to relocate her and taking care my granddaughter 6 mos old. But they are very pushy and don’t listen at all. Now email said respond in in 10 days or put a lien on my mobile home
CaliforniaI have 2 invoices for a residential customer, one dated 12/2019 ($2650.00) and the other 3/2020 ($189.95). Customer has made verbal promises to pay and made a partial pay of $1000.00 on 3/2020 on a $2650.00 invoice. Now they refuse to pay the balance. Can I still do a Mechanics Lien or should I seek another method to collect? Thank you.
