Long story short version. I had water damage , first on-site came and gave me a initial estimate for repairs. Nov 2021. Came out Dec 2021. A contractor came and gave me a run down of what was going to be done. Lots of painting , drywall etc. The first time anyone arrived to do any work was after multiple cancellations by them. A man that was picked up at Home Depot was brought to my home had no tools or anything. He was told to start putting insulation back into my walls and start painting from living room to front door of my home. My house was literally destroyed by paint in a matter of hours. I asked this gentleman to leave and then contact the contractor stating I did not want anyone back in my home. last contact with them was Jan 6 2021. I am now receiving a bill and NOI to file a lien for 7900$. First bill was Dec of 2022 I emailed the manager and we had some back and forth. Now it’s April 2023, I’ve received his notice. How is this even possible that I am being scared to think I would have to pay 7900$ for what ??? I never signed anything , no job was ever completed. I am a subcontractor who completed a road blading contract for Green Dream International on Sept 24 2022. The contract was for the Forest Service on the Kaibab Mountain in Coconino County AZ. I invoiced them Oct 9th. They paid me an amount before Nov 9th, but shorted me a significant amount. They will not respond to my e-mails. I thought I could file in Pennsylvania where one office is located which has a 120 day filing deadline if I did not get paid. Do I have to file in the state where the job was completed? I think Az only has a 60 day window, and I am past that....Read More

We manufacture cabinets. We are seeing more and more jobs pushed back and customers thinking they can leave their cabinets in storage with us without final payment (we collect 50% deposit) What can we do to enforce that customers do come and pick up their order in a timely manner - for example if a jobsite is shut down for months, our customers will not pick up their order, or pay for it until they are ready. Our company fabricates exterior metal wall panels for Commercial/Residential/Federal/State buildings. Almost all of our costs are incurred prior to shipping the panels to our customers. We provide shop drawings and engineering services, order the materials for the panels, and fabrication labor all prior to delivery. Since the majority of the documents for lien rights are based off of shipping/delivery dates, we generally send the preliminary paperwork upon shipping. In this case, we have provided the service for the shop drawings and engineering (customer has paid for these services), and have ordered and received the materials for fabrication (customer has failed to pay for materials - received and invoiced in November 2022). No preliminary notice was sent, as no panels were delivered to the job site yet. The job site is in Scottsdale AZ, (Housing/Apartment Complex) Can we still lien? What options do we have prior to looking into a lawsuit?...Read More

I am a subcontractor working on a commercial job in Arizona. My GC has terminated my contract without cause- (personal dispute) but the there is already a considerable amount of money already due. The pay app was due April 1st. Although I realize it is not extremely late, I am concerned about the termination of the contract and whether or not my lien rights are affected. This GC is notorious for NOT PAYING. And now I have spoken with another sub on this job, who has told me the GC is past due on 100K+ to them. This has me concerned. I do not want to miss any deadlines and lose my lien rights. Also, I should mention, the GC HAS been paid by the owner for the payment which would include my pay app. The owner is paying on time, and yes, my pre-liens were filed timely....Read More

We do not provide services to the construction industry as a part of our regular business activities. We were forced to provide services to the owner/developer. The property owner nor the site supervisor ever requested or told us we needed to file a preliminary lien. When the invoices became significantly larger they stopped paying. Resulting in us no longer providing services to them. I believe they are not submitting our invoices to the bank for approval. They have not disputed the charges either. What are our possible options as material facts regarding preliminary lien were withheld. Which I assume also means we do not have to conform to construction standards regarding price increases, late fees, interest, etc. This project is also a government leaseback property....Read More

I am a subcontractor working on a commercial project. My GC and I had a personal dispute, (the GC failed to pay me for 5 months on an unrelated job for the State of Arizona, and my "letter of intent to lien" gave notice to all interested parties of their failure to pay their subcontractor- this resulted in d the GC will no longer be hired for any future projects for the State of Arizona) therefore, in turn, the GC retaliated for my request for payment by terminating the remainder of all contracts with me in progress, (all unrelated) as well as any future contracts. However, there have been two payment applications already submitted for completed work. We have been working with WanRack and filed a Lien yesterday with a rapid delivery service. I have no property to lien. We worked on a project that went thru several cities with all the work being done in the Right-of-way. There is no property to lien. I sent this to your legal team and have not heard back from them. I had a deadline of today in order to do the rush delivery. Can you follow up with your legal team to find out what the status is and how I go about filing this lien? I'm a plumbing subcontractor working on a commercial renovation on which the property owner is also the general contractor. I finished a job which also had a very large change order included- which was approved- doubling the contract amount. The pay app is already overdue for payment, and the contractor is someone whom I have worked with many times. This is common practice for him to try and re-negotiate after the work is completed, and only one payment has been made. I did file the 20 day prelim when the job started, but there is no written contract. How would you suggest I proceed- I was hoping to salvage whatever is possible to continue working with him in the future.
