I looked on the web and located an air conditioning condenser and placed in cart ... l was suppose to mail payment in prior to item being shipped out... l did receive n email stating the condenser would not ship out till payment was made...l never completed the sale ... 2 weeks later an air conditioning unit was delivered to my door... about a month later they called me for payment .. they were asking full payment ... $993 ... l was offering to pay them $500 ... so they said they would put a mechanic's lien on the property were it was installed ... not the property it was delivered...are they able to do this and can l contest it...thx you in advance...Read More

Been dealing with a nightmare contractor. They have been paid in full in December and as of 1/26/18 got the COC signed indicating i owe them 0 but i put in it as of 1/24/18 sub contractor has not been paid. They have promised to send payment multiple times and i spoke the sub and they still have not been paid. The Sub back in October did file the 20 day preliminary notice but has not filed an actual lien yet. The owner said he would contact me first. The contractor is giving me the run around. It seems like other states the law favors the contractor and sub contractor not the homeowner. What can i do to force the contractor to pay so I can get a lien release from the sub? If i want to go after the surety bond it appears i might have to sue, again not homeowner friendly....Read More

A roofing company subcontracted a solar company to remove and reinstall a solar array from a 1 family home in Arizona. The contractor did not pay the solar company and the solar company doesn't have a written contract with the homeowner. I spoke to the state of arizona registrar of contractors and they stated they would have to file a no pay complaint with the state and they cannot file a lein against the home as they don't have a written contract with the home owner....Read More

We are a garage door company that completed the replacement of a customer's door. They then filed a credit card dispute and were awarded back the second payment because it was past the 30 day Visa requirement (we got the notice very late). We do not use any lien forms when signing paperwork; we do have the customer sign the initial contract that shows the deposit they paid and the remainder amount due. We are a commercial restaurant equipment supply company located in South Carolina. We finished a job out of state for a client in Arizona. We sent the notice of Intent to Lien to the customer for failure to pay balance on final invoice. We sent the final invoice to customer but they replied back wanting to deduct multiple change orders to their job. Out of the ones sent, we reviewed them and agreed to pay just a couple of them due to the fact that most of those change orders had nothing to do with the scope of work that we had quoted. I had a contractor come give an estimate for repairs on water damage of my home. The contractor had my boyfriend, who is not on the property deed or insurance claim, sign a contract. My understanding is that I have 21 days from the moment I break ground to file a pre-lien. If a pre-lien is not filed that I am unable to file a mechanics lien later down the road. So basically, within the first 3 weeks of starting a new project, I must file a pre-lien in order to protect my rights as a contractor if I was to ever want to move forward with an actual lien?
