I am a licensed contractor who did work for an HOA in Phoenix. I dealt exclusively with the association community manager who I have worked with before for this community as well as one other. He's always paid for the work done. This particular job was one that he has been expecting to fund through an insurance claim. It's been three months and not only have I not been paid, he is not returning emails or phone calls/texts. I am sure he still works for the community management company. I was engaged on an independent contractor basis to be a the CEO of a technology company and develop the basic design and business plans for their first project. I accrued roughly $340,000 in deferred compensation. The sites for that first project will be in AZ, CO or TX. I was terminated without cause in Dec 2017 with the deferred comp unpaid and roughly $1 M in severance payments due. The company has indicated they will attempt to avoid payment of either. I would like to file a lien for the deferred comp (and the severance?) on whatever is their first project or against their 8 patents which I assisted in developing. Is that possible? I did not file a preliminary notice when I started, but I have a solid contract that outlines recourse if they do not pay (but doesn't mention liens). Would that suffice for preliminary notice under AZ law? The company is a NV C Corp with HQ in AZ....Read More

We are a GC in Arizona. We received a conditional certificate of completion and a letter of compliance both from the city. Do these documents shorten my lien rights to 60 days? Also I notice the laws state the deadline begins after "completion of the project as a whole". Both the conditional certificate of completion and the LOC reference just the completion of the shell with TI work still to be done. The TI work is to be completed under a separate building permit. Does this extend my lien time to after the TI portion is completed as well? Thanks in advance for your help....Read More

We did work on a customers home, her insurance company was a nightmare and she was little help. We took her to civil court which got the insurance company to finally pay the bill. The insurance paid the home owner not us, the customer is now refusing to pay us. She has admitted she has been paid and is not refusing to communicate .. We've never had to follow through on a lien on home, we were either paid, or filed the lien because the home was put up for sale, then we were paid through closing. ...Read More
