Hello, We will be supplying materials to a Subcontractor on a project in AZ. The project is developer owned, but some of the units being constructed will eventually be owner-occupied. Should our contract with the general contractor have certain language in it that extends to the owner-occupant? Is that possible? Is a prelien notice to each owner-occupant enough, or do we need a contractual document? Thank you in advance....Read More

I have a customer that we have worked on a project for a year. The manufacturer made their windows wrong seven consistent times. We have been done with our work since July 2021. and finished the warranty work last Thursday. He has taken a self proclaimed discount of nearly 5000 for pain an suffering because of manufacturing mishaps. While waiting for warranty glass from the manufacturer. We initially took the down payment by credit card but have change our policy on credit card and not processed since because of fees for the construction industry. This customer is insisting on paying us by credit card even though his final payment mode of acceptable payment was discussed prior to him and I have told him over and over acceptable payment are checks, cashiers checks or cash. Is filing a lien the answer? being that I spoke to card services our merchant and our account is dormaint for non use. and will not fund us if we run the payments. ...Read More

The initial contract with our customer included millwork and stone. Weeks later, the customer decided they wanted to add installation, which accounts for close to $150,000.00. Rather than amending the contract, the customer treated the installation as a change order. We have three subcontracts on the same job site under the same General Contractor and job number. They want us to sign Final waivers for two of the subcontracts, but we are still working out the remaining subcontract. Can we sign these Final waivers without losing our rights on the last subcontract? I am a plumbing subcontractor working on a commercial job for a GC. The GC is refusing to mail my payment to me (which is already 30-60 days overdue) unless i sign an UNconditional waiver - or they refuse to mail my check. I tried to explain how the waivers (unconditional/conditional) work- but they are obviously do not understand the concept. They keep telling me they refuse because they can't leave themselves unprotected and it would be "bad business"- and that I am the "only sub on his jobs that seems to expect these 'special conditions'" and that I am "misconstruing the lien laws." We are only halfway through this pretty sizeable project-and I would rather file a prompt pay act violation than filing a lien-it's not the property owner- I know the owner has paid the GC- so I am not looking to make problems for the owner if not necessary.- but the pay apps were approved long ago and there are no issues with my workmanship- it is all the GC just not wanting to pay me. I am about to have a meeting with the GC and they have stated to me they REFUSE to release the money to me without that unconditional-so I just want to have my "ducks in a row" and say with utmost confidence that they are wrong- and it is breaking the law to hold my money for ransom for that waiver ...Read More

We had a water remediation company come out and they indicated they couldn’t give us an estimate for the work until the work was done and that was industry practice. What we thought would be $2500 turned into an invoice of $7200. It’s outrageously high, but they did not give us an estimate or detail what they were going to do and does not seem appropriate for the amount of work they did. I did sign something that looks more like a waiver to protect them if they damage our property. There’s language about payment, legal fees, mechanic’s lien, etc. But is this a contract since they did not give me an estimate? Can they file a mechanic’s lien?...Read More
