I am an unlicensed auto mehanic, a sole proprietor. Back in July of 2021 I spoke with a guy who had his car towed to my place on 8/9. I texted him screenshot of estimate. Several days later he agreed by text after I texted said I needed a response. A couple weeks later he said by text wanted to sell car. I agreed to buy it thru text.After several times not showing up as agreed H e finally just showed up in person to get things from vehicle. He had no title so I did not give him any money.Then on 2/11 I finally texted and told him to come get his car and he owed me $30 for estimate, $60 for 1 hour labor and $160 for the locksmith I had to pay. Also he needed to pick it up within 48 hours. and I was going to start charging storage fees. I discreetly texted him and he answered on 2/11 but has not answered my texts since I told him to come pay and get car. Can I get a mechanics lien or are there any other options I can take to get the money owed. I really dont know what options I have. Thank you for your time....Read More

We are a GC and commenced work last week at a project for which we have entered into a cost plus agreement with the owner. Since we don't have a specific dollar amount on our contract, are we to use what we believe will be the total based on our initial schedule of values? At this point, it is just a preliminary budget because we don't yet have the building plans and won't until well after our first 20 days since they are still in the works with the architect. If our dollar amount ends up increasing, would we just file an amended notice? And would we do that at the time we know what the revised amount will be, or do we need to wait until we exceed the initial amount by 30 percent? Thank you. ...Read More

When we first discussed the project we started building an addition (36’x20’). Than change orders started coming to be ADA compliment and upgrades the customer wanted to add to the addition. During mid project the customer had asked if we could re-frame the roof. We started that project thru acceptance of our invoice and verbal agreement on how we were going to re-frame the roof. Customer accepted our invoice and we began work. We demoed, re-framed, installed new shingles and fascia board, along with drip edge. We completed the roofing project and asked for invoices to be paid in full before we continued work on the addition again. Customer said he was gonna talk to his advisors and still has not paid the completion of the roofing project. So we put a stop-work order on customers addition due to non-payment. Every invoice was verbally agreed upon before projects started on customers property. Permits were pulled for addition and completed 75% of the way, we have last 2 inspections for addition (drywall and final) but will not complete until roofing matter gets resolved. We did not have to pull a permit for re-roof because we were exempt according to county’s regulations. So we are putting a lien on this property and scope of work till this matter gets resolved. We tried negotiating with customer to come to agreement so we can finish the project for the customer but that didn’t work out as well. I'm a subcontractor in AZ whose vendor is refusing to sign a lien waiver because a Preliminary 20-Day Notice has not been filed on the job. Our customer is refusing to release payment without the waiver. Is our vendor obliged to provide a waiver regardless of not filing a Prelim?...Read More

I no longer own the property and i don't live in the state anymore. Good afternoon, We are an Arizona licensed contractor that will be building a spec home for someone who has the lot/land (in Arizona) under his name. He plans to sell this house as soon as it is completed. The written agreement states that he will pay us the final contractor's fee of $10,000 at close of escrow. We also have another person that will pay us the same way only this one will be owing more than $10,000. What legal form should we use and record with the county so we can get paid at close of escrow? Do we use a mechanics lien or would a deed of trust be used instead? If a mechanics lien is used does 20 day preliminary notice need to be filed first? We have always built spec homes for us to sell never have we done it for someone else. Thank you....Read More
