I hired a contractor to re-frame a roof and then do extensive renovations on a house in Arizona. This individual completed about 85% of the roof and then provided inaccurate updates as to the progress of the roof being finished and the renovations on the house. I live out of state and was unable to check on the status and ended up paying a little too far ahead of the actual work being done. In the end, I visited the property and learned that the roof wasn't completed and, despite his inaccurate updates, he wasn't doing any of the renovations he was being paid for. I parted ways with this contractor and he now needs to pay me back the $10,000 dollars I paid him for work he never did. He has promised to pay me back the $10,000 dollars he owes me and insists he will send the money but it has already been a couple weeks and I still have not received any funds from him. I would like to begin sending him weekly notices for the next three weeks before I send him a final notice after a month that I will be taking the matter to court. Is this something you can assist me with to send these formal notices? If possible, I would like assistance in collecting the money from this contractor. To complicate matters, the house is in Arizona but he is from St. Louis, Missouri. I have his cell phone number, email, and addresses for him in St Louis. We (subcontractor) obtain a signed, written contract with the General Contractor stating that we must be paid within 30 days of completion of our work on a job site, regardless of whether or not the General Contractor is paid by the owner. I think AZ law requires payment within x amount of days only after General Contractor has been paid by owner. Are the terms of the written contract legal, or does AZ law rule supreme? ...Read More

The Preliminary Notice that was sent to our client has a notarial certificate on the last page that appears to be for the recipient to sign at the time of receipt of the notice . So my question is I was contracted to do stucco for a company I was a subcontractor they asked if I could do some drywall it's not my expertise but I do know how to do drywall I had did some drywall the previous two weeks and a couple other different jobs when it came time to get paid we only everyone only got half checks that we were told we would get the rest of our check as of that Monday I mean Tuesday because it was Presidents Day then I get told my services are no longer needed and I don't even get the rest of my check which was roughly $1,100 that he still owed me I'm a single mother this is hurt me in detrimentally I don't have the money to file even a lawsuit if I wanted cuz you didn't pay me I have pictures to prove my before and after work I have clock ins through the the places that we had to clock in at 4 my hours how do I go about getting the money...Read More

If a unlicensed GC hired you as a laborer to install the drywall in a slow building 3500 sqft custom home he was hired to complete. He agreed to pay 50% of the originally estimated contract of $16000 in quarter payments as the work progressed accordingly. The job has taken over a month to complete and with only 2 closets left will be done tomorrow. I have only been paid a total of $900 so far and that was 3 weeks ago. Yesterday I was told that the homeowner only owes another $2500 for the job and that will be split between the 2 of us which will ultimately end up a payment of $1250 and a total payment of $2150 for what I've counted out to be 64 days of work and just under $40 a day. This job is 3 hours outside phoenix (home) and granted the GC allowed me to stay at his house for the duration of the job I still paid all my own travel expenses and used my truck to and from the job site and etc... What should I do at this point? ​ Should I approach the homeowner directly even though I'm not the one contracted got the job? Do I start the process on a mechanics lien against the homeowner now to ensure I meet the deadline to file? The state of Arizona doesn't require a preliminary notice be sent, but it feels wrong to go to such an extreme without even talking to him first... Or do I file suit against the one who brought me in on the job ? He doesn't have a contractors license or any certifications so I'm not even sure I can do that, not to mention the state of Arizona considers any job taken by an unlicensed contractor that pays over $700 a felony so if I file a mechanics lien claiming to be unpaid subcontractor that would leave me open to felony charges and in worst case scenario could lead to possible prison time. I was hired as a worker to assist on completing a job but can't accept a payment that ultimately doesn't even meet minimum wage for an out of town trip no less....Read More

We have 3 signed contracts for a total of $117,000 but the customer asked us to leave the job 2 weeks before completion. $60,000 has been paid we filed our pre lien right after being removed from the job. In which time I’ve $40,000 of work had been done with in that 20 day period. I need to order a stop notice\notice to withhold construction funds.
