We are performing work on several commercial projects. The owner is paying us directly for one trade, and a second trade is being paid to us through a general contractor. The owner has paid us for their portion of the work, the general contractor has not. The owner is asking us to sign a waiver for all work performed through a certain date. The dollar amount listed on the waiver is the dollar amount we have actually received, however we still have outstanding invoices that must be paid by a non-cooperative GC for properties directly listed on the lien. If we sign this waiver, are we forfeiting our rights to place a mechanics lien on these properties, should the GC never pay us? ...Read More

I recent had some tile replace and base board installed in my home. The person I hired was not a licensed contractor but said he does this type of work and sent photos. He completed the tile work but workmanship is not great and is likely to fail in the near further. As for the baseboard he failed to finish and walked off the job because of a disagreement about the tile quality. He is now demanding payment but I am reluctant due to having to finish the baseboard and the quality of all work that was completed. What are my rights in this case?...Read More

Hello, I started a job and completed it on March 17 and sent the invoice on the 18th. Was taking a long time getting paid and someone told me about a mechanics lien so I found you guys and started the process. The preliminary notice was sent on April 7th which is 21 days after completion but 20 days from sending the invoice. Notice of intent to lien was sent on May 12th and with all this sent, I am still being ignored by the general contractor. Am I out of luck with filing a lien since I live in Arizona and he knows it which is why he’s ignoring me? I really don’t want to deal with going to small claims court for $1100 and would rather lien the property so they put pressure on him to pay me. Is small claims court my only option now or can I still go forward with placing a lien? Thank you ...Read More

After over a month of not returning my calls or responding to the continuous sending late invoices the general contractor that owes me $1100 finally text me after receiving the intent to lien. With this being my first time dealing with this I unfortunately didn’t make the 20 day deadline and sent the preliminary at 21 days. He’s messaging me telling me if I don’t remove the intent to lien by today his lawyer is going to sue me for $5000 including attorney fees. He knows I didn’t meet the deadline so I don’t know why he’s keeping my money owed and threatening to sue...Read More

I'm a plumbing subcontractor and the general I am working for pushes the "pay when paid" clause that is in our contract. Isn't there any sort of limit to this? What if I think the contractor is being dishonest about not receiving payment? Isn't there some way for me to verify this? I am a 1099 sale rep for a national flooring chain. i have an Arizona LLC that they pay when projects are completed. Two issues. im sure i lose the 1st one. The product offered an 8% commission on the sale. It was $42k. The product arrived for install and the warehouse sent the WRONG color and wrong rogue name on upc barcode label. I stressed it was wrong. Quite obvious gray tone when she picked a brown tone. Customer goes sideways and choses another color. That new color is not 8%, its 4%. I lose $1600 instantly due to Warehouse error that everyone said was my fault (how????). Second, regardless....it is now two months since job was completed. I have been asking for payment for about 4 weeks. Crickets. "Head AZ Market Manager" and all others ignore my emails and texts. Here we are... ideas. thoughts? The company is POORLY managed in AZ. I did some work for a friend, remodeled a house he owns in Arizona, where I have also been living . We have a mostly amicable relationship...but we discussed I should file a lien on a property (Single Family Home) he owns in New Mexico...to be sure, in case he dies, or some other unexpected thing might come up...that I can get the $100K I'm owed for the work I've done on the house in AZ. So I filed the lien on his property in NM...for $80K ...rather than the full amount...b/c we have been considering whether or not I should get the rest of what I'm owed for the work I did, in the form of payment...or whether we'll apply that (remaining $20K) in the form of my owning a share of equity in the property in AZ. We haven't decided about that yet. So...I'm wondering if it might be in my best interest to file a lien on the AZ property, too....and maybe for the full amount of the $100K. Would the fact that I've already filed a lien (for the $80K) in a different state...somehow nullify or minimize the viability or legitimacy of a second lien (I might file) for the full amount in AZ? Is there anything else I should know about this? I'd be willing to pay an atty for a brief consult, but I'm single, 62 year old disabled woman, living on a VERY low fixed income, that is well-below the poverty level criteria. So, I don't really have any disposable income for paying professionals for these kinds of things. I'm hoping this "Ask a question for free" might actually be legit...but I'm guessing it's probably just another online marketing hook to try to get business. Can / is anyone willing to help? We prepared drawings for a contractor in Canada in anticipation of a supply and install contract in conjunction with the project. When they failed to contract us, we billed them for our drawings (since we found out they were using them to provide to other contractors to build our system) .
