My AK unlicensed, unbonded, uninsured roofer installed my new roof over rotting facia, requiring an unknown amount of additional work to be done in April. Do I owe the entire amount he billed me, or the difference between what the new roofer will charge to fix his work? He has filed suit for the entire amount; I've retained two inspector reports supporting the incorrect work being done, and the cost to fix it. The total amount of work necessary cannot be determined until next spring, yet the lawsuit is now. I have paid nothing of the $9800 charged. Additionally, he left 1600 nails strewn around the property. It took me 4 days to pick them up, after he did not appear to do the work himself, although he said he'd be over. I am a sole proprietor working as a Handyman/General Contractor duly licensed insured and bonded in the State of Alaska. My current situation is that I have/had a verbal agreement with a property owner to provide various labor at the rate of $30 per hour to effect the following: remove/modify portable garage door opening; relocate and consolidate wood/debris piles from multiple locations to one as directed by property owner; patch damages in skirting of structure; install vapor barrier material and blocking under structure and around skirting; staple vapor barrier all around skirting - top to bottom; relocate fill dirt under structure to around edges of skirting along the entire perimeter of structure; purchase and install roof vent and cap. I completed the work and submitted my bill in the amount of $610. Property owner is of the opinion that I overbilled and dragged the time out even though he was present on the property for the majority of the time I was working each date billed. The customer is trying to compare the pricing to installation of flooring materials and has stated that a payment for $300 was more appropriate and all he was going to pay. He stated in Dec that a payment was sent out for $300 which was never received. I sent a final demand invoice noting further legal action would be taken. He again reiterated he sent a check which we have not received. I sent a Notice of Right to Lien and the property owner went ballistic, left derogatory comment on my wife's business that it was a scam artist and thief and she runs a vacation rental, threatened me with his Divorce lawyer with 40 yrs experience and that he has lots of friends. My wife who has over 10 years experience working in the construction industry has recommended that we file the Claim of Lien but I would like to send one more letter advising him that he agreed to the hourly rate and that installation of flooring does not compare to the work he hired me to do. She advised against that. I am just wanting to get paid for the services provided. What should be our next step beside small claims court....Read More

We had a person that was supposed to purchase our home in Alaska. Unknown to us he supposedly remodeled and made improvements to the property. After he went 12 months without making the payments as he was supposed to we filed a Eviction. In retaliation he filed liens for the work he did against the property. there was no contract, in fact we had no knowledge of work being done until he sent us copies with his answer to the eviction. He has failed to prove he actually did the work as he has denied us access to the home and we want to know how to proceed? He is asking approx 35,000 for work he supposedly did and another 14,000 for capital investment in the property. At this point now he is approx 39,000 in arrears and refuses to leave the house until we pay him for the liens. Can he be made to remove the liens and we are not responsible in any way for payment to him. ...Read More

I am a single mom. I hired an electrician to do some repairs and install some fixtures at my newly purchased economy house. The total work would have taken about 25 hours. He came a worked a couple hours, disappeared for weeks, came back and worked another couple hours, disappeared, etc. He put a supplemental circuit box in my kitchen and mis-measured it so it is too low for the cabinet that goes there, so it has to be re-positioned. He put some conduit for an outside entry light at my front door, but it came loose and presented an electrical hazard for my children so I had to get someone else to remove it. Over a 3 month period, he worked 15 hours in 2 -3 hour widespread increments. The last time I saw him, he indicated he would be back. Instead, he sent me an invoice for 17 hours (1 hr of which was his mis-adding) and a whopping $577 for "materials" which were not itemized. I had furnished all the fixtures and most of the outlets, boxes, etc. The circuit box he installed in the kitchen was $36.94 retail with 4 breakers totaling under $40. That leaves $500 of materials unaccounted for. I paid 75% of his bloated invoice with a note that I would pay the rest when he finished the work, fixed his mistakes, and provided an itemized list of materials. Today he sent a text saying if I did not immediately pay the remaining $577 of his invoice he would put a lien on my house! This is crazy! I've been patiently waiting for him to come back to finish. I'm the one who has the legitimate complaint! I expected quality workmanship done in a timely manner and I got neither. I am now left having to hire someone to correct his errors and finish the job he started. I do not want him to put a lien on my property for the disputed balance of his invoice, nor do I want to pay him money that I question is legitimate. What should I do? ...Read More
