Writing of a lien for CT

New YorkMechanics Lien

HI there, We are in the business of purchasing constructions outstanding constructions invoices. Our customer Royal Power sold us invoices and have not received a payment yet. We want to file a lien, and the state of CT request someone to sign and notarize the lien. We got the form ( order # 2815877) and my colleague noticed that the writing is Royal Power, but he does not work for them. We are Blue elephant and we one those invoices. The questions is, will the writing stay the same or will it have to be change so it has Blue Elephant on it. This is a really important question as we only have 9 days to file. Please provide an answer ASAP. Feel free to call me if you have any questions. thank you

First, it's important to note that the Expert Center is available to answer construction law and construction payment questions - including those related to mechanics lien claims. However, I'm not able to instruct you on how to fill out any lien form, and I can't provide legal advice on how you should proceed in your specific situation. For more clarity on that front, it might be helpful to consult a local Connecticut construction attorney. Still, I may be able to provide some information that should be helpful for you in pursuing a claim on your own.

Connecticut mechanics lien basics

When filling out a Connecticut mechanics lien, there's some basic information that must be included. For one, the "claimant" is the party making the claim of lien. Further, the property owner must also be present on the claim. And, the claimant's customer (the one who hired the claimant) must also be on the template as well as the prime contractor for the project. Connecticut mechanics lien rights, generally

Mechanics lien rights are generally available to those who perform work and go unpaid for that work. It's not uncommon for one company to purchase another company's debts - but note that the right to lien generally lies with the party who performed the work, even when that debt is sold to someone else. You can read more about who's entitled to Connecticut lien rights here: Who can file a Connecticut Mechanics Lien? In most cases, the right to file a mechanics lien lies strictly with the lien claimant, themselves. But, once a mechanics lien has been filed, that lien might be assigned to someone else - such as the party who purchases the lien claimant's debt. More on that idea here: Assignment of Mechanics Liens (But Not The Right to Lien).

Bottom line

If you're concerned about how, exactly, to fill out your lien template, or if you're unsure of whether you're entitled to file a mechanics lien, it'd be wise to touch base with a local construction attorney. They'd be able to review your circumstances, provide advice on how to fill out any relevant documentation, and even shed some light on how best to proceed in your situation.

Hi Matt,   Thanks for you answer. However i still dont know how to proceed. The lien that we filed and got a copy has Royal Power on it and we are not employees of Royal Power. I asked support, but they send me to ask a question on the main site. Should i call my account manager?   thanks, Adriana

I apologize for any confusion or miscommunication! The Expert Center isn't intended for Levelset system questions - so, for questions regarding a Levelset order, it'd likely be more helpful to reach out to your account manager.
