Would I list my GC on a lien if he was a qualifier to pull the permit for the job?

FloridaMechanics Lien

I'm a carpenter that built a deck, and the homeowner hasn't paid his final payment. I've sent a notice of intent to lien, and I need to file a lien. There is a GC on the job, but he was just a qualifier to pull the permit. I was working "under" this qualifier GC. Both the GC and I have signed contracts with the homeowner. Would I still put the GC on the lien and that I was hired by the GC, even though I got the contract with the homeowner?

Your question raises several issues. If the work required a licensed contractor to perform it, then your contract may not be valid. If it did not, then you're probably fine to leave the GC off your lien. This also raises the issue of whether a notice to owner was required for this project and whether you timely sent it. You should probably consult with an atttorney to learn exactly what rights are available to you and what limitations there are. Even if you don't have a lien right, you may have other rights to payment. Feel free to reach out if you have other questions.
