Who's responsibility is it to pay us employees prev. Wage?

IllinoisPrevailing Wages

So I work for a large company that does maintenance on standby generators. We do alot of villages, public works, fire stations, water treatment centers, etc. I have asked our HR dept and they said it is up to the customer to alert us if we are to be paid prevailing wage. I think my company just doesnt want to pony up the dough and pay us. What's your thoughts?

Generally, yes: A public entity should notify their contractors if they're required to pay prevailing wages. And, with that information, a contractor should usually bid their jobs with those prevailing wage requirements in mind. So, if your employer hasn't been notified about any prevailing wage requirement on the job or required to provide certified payrolls, then there's a strong chance that the work doesn't require prevailing wages. If you believe prevailing wages are required but aren't being paid, then it might be helpful to bring that to the attention of your supervisor in addition to the HR department. Alternatively, it could also help to reach out to the contracting agency who's letting the job. If that goes nowhere, then consulting with an Illinois who's familiar with the state's prevailing wage requirements might help, too. And, if necessary, filing a wage and hour complaint with the Illinois Department of Labor can help get to the bottom of things. Though, it might be wise to ensure whether the jobs truly do require prevailing wages before jumping to that point. For the basics on what kinds of jobs will usually require prevailing wages, this resource should help: Prevailing Wage Illinois: The Basics, Obligations, and Violations.
