Who do I use worker or business?

I hired a licensed company I found online for bathroom tile install. The estimator came to the house to give a quote. Everything was done over texting and I hired him. The worker/estimator did all the work. He never gave me contract nor receipt. Job went bad and I have to demo everything. Worker/estimator stopped receiving call. I looked up company on CA state license page and called and turns out this estimator was not the owner but just a regular w2 employee. Owner spoke with his employee (which happens to be a relative) and employee agreed to refund me full about. $3,600. Employee was suppose to give owner check for owner to mail to me. Owner fired employee before receiving check and lost all contact with him. Now owner is saying he has no involvement because there was no contract signed, he was unaware, and his employee went rouge. Owner told me to go after (sue) his now former employee. Do I send demand letter and sue former employee or employer or both? Found out where employee lives through truthfinder.com. On CA state license board employer has a p.o box. Though secratary state webite that company address is the same as employee.
