where are liens filed

I just found out we have a mechanics lien against our property. We have had no notification of this. I do I find out where the lien is filed and what is required to get it released? Richard Weitzel 949 677 1252

Hello Richard,

Liens are recorded in the County Recorder's Office. How did you learn of the lien? When was it recorded? There are various ways to get it released, but how you do it may depend on the answers to several additional questions!

Lien was filed nearly 18 months ago, 6 months after work stopped on the kid. We received no notification and have heard nothing from the other party. I learned of from a a solicitation to sell the property. Have gotten a copy from the county.

Thanks Richard. From the little we know, it sounds like the lien is stale since liens have to be foreclosed on within 90 days from the date they are recorded. You (or an attorney) can start with a demand letter, advising that if the lien is not removed promptly, that you will file a petitition to expunge the lien and recover your attorney's fees from the claimant. If the project is not over yet on the entire project or was recently completed, it is possible for the claimant to release the stale lien and record a new lien.
