When to file a lien

Texas

Hello, I’ve just ended a contract with a customer on Friday, July 3, 2020. In which the homeowners were to provide all materials needed to complete the project. The homeowners failed to have countertops installed until the day of the contract ending which means we could not complete the backsplash they were wanting. We gave them a weeks notice that if the countertops were installed before fridayJuly 3, we could not complete the job. Also, they failed to provide flooring before the contract ended. Now they are refusing to pay for the rest of the work we have completed even though I took off both the flooring labor and backsplash labor from the invoice.

Hello, This is a residential construction contract and your relationship is directly with the owner so you have until the 15th day of the third month following this month to file a lien. By my calculations, you have until October 15th to file a lien. You are not required to send a pre-lien notice but one is advisable just to make sure you're communicating with the owner. E.
