Does the timing for filing a lien start in the State of Texas begin with the date an invoice is posted by the contractor or the date the invoices is received by the client?

In Texas, the deadline to file a lien is determined by month - not a particular day. The deadline to file a Texas mechanics lien is the 15th day of the 4th month after the last month in which the claimant furnished labor or materials to the project. However, for residential projects, the deadline is shortened to the 15th Day of 3rd month from last furnishing. So, the date the invoice is posted or received is only applicable to the extent it corresponds to the last month in which work was performed. Generally, the date the invoice is sent can be used as a proxy to determine the last month labor or materials were furnished, but there is no difference with respect to the date sent or received as long it is still in the same month.
