What's the difference between a mechanics lien and a residential lien
A mechanic's lien may be asserted against commercial property or residential property. But the procedures and law applicable to commercial liens and residential liens may be different. If a contractor wishes to file a mechanic's lien against an owner's homestead property, the contractor would have to perfect a homestead mechanic's lien contract. The process involves the inclusion of statutory warnings to the owner, signatures by husband and wife, and recording of the contract with the county clerk (among other items).
