What type of lien should I file for a land owner that has not paid their road maintenance fees?

A land owner in our SD signed paperwork saying they would pay their road maintenance fees yearly. They have not and now they owe $3500 in fees. They are refusing to pay and I need to know what type of lien I should file.

It is difficult to answer this question without knowing more about your role.  At first glance this sounds like a homeowners’ association issue, if the fees arise as obligations under the subdivision covenants/declarations.  If so, the HOA would have a right to file a lien for unpaid dues/obligations.  Absent that, I would be unable to answer this question without more information.
